ATTENTION: People with section 48 barred & NZ Travel
It has come to our attention that people with section 48 bar (prior visa refusals) are tempting to use New Zealand Trans-Tasman travel bubble to by-pass section 48 bar and get invitation for 190/491.
IT IS VERY RISKY and Wickham Lawyers strongly discourage this strategy and encourage you to do your independent research on the following issues: -
1. Visitor Visa for NZ - Evidence that you are a genuine visitor (prior visa refusal in Australia and/or currently on AAT or Federal Reviews makes it very difficult to obtain NZ visitor visa);
2. Bridging Visa B – Have substantial reasons for wanting to travel.
3. PIC 4020 - providing bogus documents or information that is false and misleading in relation to a visa that you held in the 12 months before making your current visa application.
4. Current State Nomination Policy in relation to s48 bar - For the remainder of FY20-21, BSMQ is not processing applicants who are s48 barred. This will be reviewed in FY21-22. It is unlikely that State Governments will invite anyone who has taken advantage of New Zealand Trans-Tasman travel bubble to seek invitation for 190 or 491 visa.
Please do not contact BSMQ regarding the Australia – New Zealand travel bubble, to request a s48 barred application to be considered – as per above, they are NOT processing these applications in FY20-21.
5. Uncertainty due to Global pandemic - Imagine what will happen if you have left Australia on Bridging Visa B and the AU-NZ international borders are closed again due to sudden outbreak in Australia or New Zealand.
Please avoid rumours, misinformation, incorrect advice and do your own independent research.

The Australian Government recently announced a number of changes to Student and Graduate visa arrangements following the disruptions caused by COVID-19, addressing some key issues raised by International Students and Universities alike.
The following information has been made available so far.
Australian Study Requirement
International Students who currently hold a valid Student visa and are studying online from overseas will be able to count that study period towards the Australian Study Requirement for a Graduate Post-Study work visa.
Graduate Applications from Overseas
International Students who have completed their studies will be able to apply for a Graduate visa from outside Australia if they are stuck overseas due to the COVID-19 restrictions.
Processing Restarts
Student visa applications will start processing again, so visa holders are ready to travel when the Australian borders reopen.
Fee Free Applications
Certain International Students will be able to lodge a new Student visa application without fee if they were not able to complete their studies during the validity period of their original Student visa due to COVID-19.
English Testing Extended
Applicants will be given additional time to provide English language test results where there have been disruptions to testing services due to COVID-19.
Please note that the above changes require new legislation to be released by the Department.
Details on eligibility criteria and requirements have not yet been released.
Wickham Lawyers will keep you informed in this matter.

Temporary Visa Holders - Return to Australia - NOT until travel ban is lifted.
The Department of Home Affairs says there are NO plans to grant temporary visa holders a blanket exemption to Australia's coronavirus travel ban, despite pleas from those stranded overseas to be allowed back into the country.
Temporary Visa holders caught out by the travel ban have told that despite calling Australia home for several years before the pandemic took hold, their applications for exemption on compassionate grounds have still been denied.
Australia’ borders would remain closed to everyone other than Australian citizens and permanent residents and eligible family members, for the foreseeable future.
Several temporary visa holders who have been separated from partners in Australia, have also had their applications rejected.
If a vaccine is found it will change the equation but at this stage keeping Australia’s borders secure is a very strong priority.

Wickham Lawyers and A***n International are pleased to announce a collaboration agreement to deliver high class and customised international students’ recruitment services that will include education institution applications and admissions, assistance with student visas, living arrangements in Australia and ongoing career counselling.
As part of this collaboration, Wickham Lawyers and A***n International will:

• Ensure students receive accurate and current information about their study options, including campus locations, facilities, entrance requirements, information about the different courses, and tuition fees;
• Ensure students receive information about living in Australia, the local environment, costs of living and accommodation options;
• Ensure that the selected course is right for our client based on our client’s experience, English level and previous qualifications including information on content, duration, qualifications, tuition fees and payment/refund policies;
• Ensure international students are aware of the conditions of their student visas and ensure they comply with these conditions; and
• providing immigration advice.
