The Scottish Court of Session has today ruled that providing multi-user unis*x toilets in a primary school amounted to indirect s*x discrimination against female pupils.
Parents of a Primary 1 pupil challenged West Lothian Council's unis*x toilet setup at East Calder Primary School, opened in 2024.
Lady Poole ruled in Edinburgh's Court of Session that shared wash basins and spaces breach 1967 regulations requiring fully separate sanitary areas for boys and girls, and indirectly discriminate against females under the Equality Act 2010 due to hygiene and vulnerability issues. The council must now comply with the law, following similar rulings and updated guidance favoring single-s*x facilities.
