One of the key purposes of the Occupational Health and Safety Act (OHSA) is to ensure the health and safety of persons in connection with the use of plant and machinery.
The responsibility for achieving this rests with the employer.
In fact, section 8(2)(i) of the OHSA specifically requires employers to ensure that machinery is operated under the general supervision of a person trained on the hazards and authority to implement precautionary measures. These responsibilities and requirements are extended to the GMR 2, who takes on overall accountability for the general supervision of machinery.
A competent GMR 2 appointee is not only responsible for machinery governance and legal compliance, but also for driving safe engineering practices, operational discipline, risk management, and statutory compliance throughout the organisation.

General Machinery Regulation 2(1) requires South African employers who use machinery on their premises to appoint a competent person to supervise machinery.
This requirement can be traced back to section 8(2)(i) of the Occupational Health and Safety Act, which states that one of the employer's general duties is to ensure that machinery is operated under the general supervision of a competent person.
The General Machinery Regulations provide a broad description of the duties of the GMR 2.1 appointee to ensure the employer complies with the provisions of the OHS Act and the regulations.
During our many interactions with the Department of Employment and Labour, there is a consensus that some GMR 2.1 and 2.7(a) appointees may not fully comprehend the extent of the role.
If the GMR 2.1 and 2.7(a) had undergone additional training beyond the GCC Factories, this would have correlated with a decrease in non-compliance and preventable workplace incidents.
