[PRESS STATEMENT] In a ground-breaking judgment handed down yesterday, the Labour Appeal Court has ordered to retrospectively reinstate Mr Vuyani Qomoyi, finding that his dismissal was substantively unfair. Mr Qomoyi was dismissed in 2021 for allegedly “displaying racist behaviour”. The Court overturned the Labour Court’s decision in its entirety which upheld the dismissal and included punitive costs against the farm workers’ union, the Commercial, Stevedoring, Agricultural and Allied Workers Union (CSAAWU).
This marks a significant victory for both Mr Qomoyi and the broader labour movement. The judgment is an important affirmation of the right to free speech and clarifies the standards for determining racism in the workplace. Both issues are critical, particularly in the context.

On the 02 October 2025 at 04h00Dada Morero and Nomoya Mnisi decided to stop our members on making an honest living by selling their goods. Up to date, these members are still at home, not able to feed their families. SAITF will fight this until the end.

As schools open today, please remember:
No child may be denied access to school.
The Gauteng High Court has confirmed that no private person or group may interfere with anyone’s access to education or healthcare, regardless of nationality or documentation status.
❗ Only immigration or police officers, acting lawfully, may ask for documentation and never at schools, clinics, or private spaces.
If you are turned away, or if you witness learners being blocked or intimidated: ➡️ Report it
➡️ Refer to the court order
➡️ Seek legal support immediately
