POLICE BAIL OVER THE DECEMBER PERIOD – WHEN ARE YOU ENTITLED TO IT?!

December is a period when arrests increase significantly due to roadblocks, festive-season operations, drinking-and-driving incidents and public disturbances.

Many people are unsure of their rights once arrested, particularly regarding police bail.

Today I will outline when a detained person may lawfully be released on bail by the police, the governing legislation, and practical guidance for the public.

The Criminal Procedure Act 51 of 1977 regulates Bail in South Africa 🇿🇦

The rules regulating police bail are mainly contained in sections 59 and 59A of the Criminal Procedure Act (“CPA”).

These provisions empower certain police officials to grant bail before the first court appearance, provided certain requirements are met.🚓👮‍♀️

When Can You Get Police Bail?

Section 59 Bail (Granted by the Station Commander)

Under section 59 of the CPA, an arrested person may be granted bail by an officer not below the rank of Warrant Officer after being charged but before the first court appearance, if:

- The offence is not a Schedule 5 or 6 offence (i.e., not a serious or violent offence).
- The investigating officer raises no serious objection.
- The arrested person confirms a fixed address and identity.

Examples where police bail is usually available:

- Drinking and driving 🍻
- Common assault 🤺
- Culpable homicide (depending on circumstances)☠️
- Theft under R2,500🥷
- Reckless/negligent driving
- Disturbing peace🛌🛏️
- Trespassing ⛔️

Important: Even for culpable homicide (example: you knock someone with your car and they pass away), police bail is often possible, unless there are aggravating circumstances such as drunken driving causing death.

Section 59A Bail (Granted by a Prosecutor at the Police Station)

Where the offence is more serious, the prosecutor may authorise bail under section 59A.

This usually applies to offences that fall under Schedule 7, such as:

- Assault with intent to do grievous bodily harm (GBH)🤺
- Fraud 🗂️📑
- Domestic violence-related charges 👩‍❤️‍👨👩‍❤️‍💋‍👩🧑‍❤️‍🧑
- Theft above minor thresholds🪙
- Certain drug-related offences💉💊

In such matters, police cannot release the suspect without consulting the prosecutor.

When You Cannot Get Police Bail

Police bail is not allowed for the most serious offences, including:
• Murder⚰️
• R**e
• Robbery with aggravating circumstances
• Any Schedule 6 offence
• Some Schedule 5 offences
• Cases where the accused is a flight risk or has outstanding warrants
• Offences where the investigating officer strongly objects due to risk of interference with evidence or witnesses

In such cases, the accused must appear in court, where a formal bail application is launched before a Magistrate.

December Considerations: What the Public Must Know

Court Closures & Weekends!!!!

During the festive season, courts may operate on limited schedules.
This makes police bail extremely important because it can prevent a person from being detained unnecessarily for the entire long weekend or public holidays.

Police Bail Not Automatic

Even where it is legally possible, the police retain a discretion.

Arrested individuals should insist that their legal representative engages the investigating officer and station commander immediately.

Rights of an Arrested Person

Once arrested, you have the right to:

• Be informed of the reason for your arrest
• Contact a lawyer and a relative/friend
• Apply for police bail where legally permitted
• Appear before court within 48 hours if bail is refused

No person may be detained indefinitely or without cause.
