SOUTH AFRICA’S CORRECTIONAL CENTRE OVERCROWDING I believe we can all agree that South Africa has social and economic challenges. Some of these challenges contribute to crime and the resulting overcrowding of correctional centres (prisons). In South Africa we have approximately 167 343 prisoners behind bars. Approximately 60 000 of these are awaiting-trial prisoners. Of these, 2600 are detained because they cannot afford bail amounts of R1 000 or less. We also know that it costs approximately R 15 000 per month to detain an inmate. So, we are incurring costs of R 39 000 000 per month (2 600 x R 15 000) because of a once-off amount of R 2 600 000 bail (2 600 x R 1 000) that is outstanding. It is estimated that 11 out of 16 (68.75%) awaiting trial detainees do not result in a sentence of imprisonment, due to: - withdrawn charges - struck-off cases - acquittals. So, of the 60 000 awaiting trial detainees, only 20 000 will result in a conviction and a sentence of imprisonment. So 40 000 are potentially wastefully held. How wasteful? 40 000 detainees at R 15 000 cost per month to detain: = R 600 000 000 per month (40 000 x R 15 000 per month), equating to: = R 7 200 000 000 per annum (R 7.2 Bn) The legal maxim that it is better for the guilty to go free than for an innocent person to be convicted is a foundational principle of the American criminal justice system, often cited as a cornerstone of due process. While the popular phrase varies in number, this concept is commonly known as Blackstone’s Ratio or Blackstone’s Formulation.
