Can the state search the many in order to find the one?

Tower Dumps & Geofence Warrants
Most people hear terms like “tower dump” or “geofence warrant” and assume they are obscure technical procedures. But the principle is simple and serious. A tower dump asks a phone company for information about every device that connected to a particular cell tower during a certain period. A geofence warrant asks for information about every device detected inside a defined geographic area.

In both cases, the investigation may begin without a known suspect.

Instead, the state gathers information about everyone who happened to be nearby and then sorts through the crowd looking for someone to investigate. That reverses the traditional logic of search.

It is no longer: find a suspect, then search. It becomes: search everyone, then decide who looks suspicious. That means delivery drivers, neighbors, workers, protestors, patients, commuters, customers and people simply passing through can all be swept into the same digital net. And location data reveals more than where a phone was once detected. Over time, it can reveal where someone lives, works, worships, receives medical care, organizes politically or spends time with others. A map of movement can become a map of a life.

This is why the issue is larger than privacy in the abstract. It is about whether ordinary presence in public can be converted into evidence without prior suspicion. The technical language makes the process sound neutral. It is not neutral; it is a dragnet.

The state once had to identify a person and justify searching them.
Now technology makes it possible to search the crowd first and decide whom to suspect afterward.

That is a profound shift in power. No one is saying these tools can never help solve a serious crime. The question is whether usefulness alone is enough to justify searching large numbers of innocent people. The argument says capability is not authority and efficiency is not legitimacy.

The Commons question is simple:
Should the government have to know whom it is looking for before it begins searching or may everyone be searched so the government can decide whom to look for?

First they gather the crowd. Then they decide who matters. The state once had to find a suspect and then search. Now it can search the crowd and then decide whom to suspect.
