NC DWI statute:

North Carolina's DWI statute, NCGS § 20-138.1, defines impaired driving as operating a vehicle on a public roadway while under the influence of an impairing substance. This includes having a blood alcohol concentration (BAC) of 0.08% or higher, or 0.04% for commercial vehicles. The statute also defines "impaired" as having any amount of a Schedule I controlled substance in your blood or urine.

Question often asked is, “what is limited driving privilege?”

In North Carolina, a limited driving privilege (LDP) allows a driver to operate a vehicle under certain restrictions:

Hours
Drivers are usually permitted to drive between 6 AM and 8 PM, Monday through Friday, for work and school.

Work and school
Drivers can request an extension to drive outside of these hours if they provide a letter from their employer or school schedule.

Emergency medical care
Drivers can drive at any time and without restrictions for emergency medical care.

Community service
Drivers can drive to perform community service or attend treatment programs as needed.

Household maintenance
Drivers are usually only permitted to drive for household maintenance during standard working hours.

Routes
Judges can restrict drivers to certain routes.

Other restrictions may apply, and driving that is not related to the permitted categories is unlawful.

To request a limited driving privilege, a person must file a petition in district court and attach a copy of their motor vehicle record. The petition must also include a sworn statement that the person is eligible for a limited driving privilege.
