BREAKING ATF UPDATE: TEXAS SUPPRESSOR LAWS HAVE CHANGED!
BEFORE vs. AFTER: THE NORTHERN DISTRICT OF TEXAS RULING AND ATF’S OCTOBER 9, 2026 GUIDANCE
If you own a suppressor, want to purchase one, manufacture one for personal use, or loan one to someone else, you need to understand what changed and what DID NOT.
This is a major development for Texas gun owners.
FIRST, WHAT HAPPENED?
On August 5, 2026, the U.S. District Court for the Northern District of Texas issued a ruling restricting enforcement of certain National Fi****ms Act (NFA) provisions.
Initially, the injunction protected specified parties, including certain organizations, their qualifying members, and covered customers.
THEN CAME OCTOBER 9, 2026.
ATF announced a NATIONWIDE nonenforcement policy covering certain NFA provisions for suppressors, short-barreled ri**es, short-barreled sh****ns, and weapons classified as AOWs.
YOU NO LONGER NEED TO BE A GOA MEMBER OR SILENCER SHOP CUSTOMER TO BENEFIT FROM ATF’S POLICY.
But this is enforcement discretion, NOT a complete repeal of the NFA.
BEFORE THE CHANGES:
❌ $200 NFA making or transfer tax.
❌ Mandatory Form 4 and ATF approval before an ordinary suppressor transfer.
❌ Mandatory Form 1 and ATF approval before personally manufacturing a suppressor.
❌ Mandatory NFA registration.
❌ NFA maker’s engraving requirements.
❌ Loaning a suppressor to someone outside your registered trust could constitute an unlawful transfer.
AFTER THE OCTOBER 9 ATF GUIDANCE:
✅ $0 NFA TAX. Congress reduced the making and transfer taxes for suppressors to zero effective January 1, 2026.
✅ FORM 4: ATF is no longer enforcing the NFA requirement for prior approval of covered suppressor transfers.
✅ FORM 1: ATF is no longer enforcing the NFA prior-approval requirement for covered personal manufacture.
✅ REGISTRATION: ATF is no longer enforcing mandatory NFA registration for covered suppressors.
✅ ENGRAVING: ATF is no longer enforcing NFA-specific maker’s engraving requirements.
✅ NATIONWIDE APPLICATION: The October 9 policy is not limited to the plaintiffs or organizations protected by the Texas injunction.
BUT HERE IS WHAT STILL APPLIES!
❌ FORM 4473 IS NOT ELIMINATED: Ordinary suppressor transfers through federally licensed dealers still generally require ATF Form 4473.
❌ BACKGROUND CHECKS ARE NOT ELIMINATED: Dealers must still comply with applicable federal background-check requirements unless an exception applies.
❌ MANUFACTURER MARKINGS ARE NOT ELIMINATED: Commercial manufacturers must still comply with applicable Gun Control Act serialization and identification requirements.
❌ FFL AND SOT REQUIREMENTS REMAIN: Commercial manufacturing and dealing remain subject to applicable federal licensing and tax requirements.
❌ PROHIBITED PERSONS REMAIN PROHIBITED: Federal restrictions on possession by prohibited persons remain enforceable.
❌ STATE LAWS STILL APPLY: Federal enforcement discretion does not override state restrictions.
❌ DO NOT ALTER SERIAL NUMBERS: Do not remove, alter, or obliterate existing manufacturer serial numbers.
WHAT ABOUT SUPPRESSORS YOU ALREADY OWN?
Previously registered suppressors do NOT automatically become deregistered.
Existing registrations remain in ATF’s records.
ATF’s guidance provides a procedure to request removal from the NFA registry, but consider the consequences carefully.
If enforcement resumes, an unregistered suppressor is not automatically grandfathered, and re-registration may not be available without an amnesty or another lawful procedure.
DO NOT ASSUME REMOVING YOUR SUPPRESSOR FROM THE REGISTRY IS NECESSARILY IN YOUR BEST INTEREST.
CAN YOU LOAN YOUR REGISTERED SUPPRESSOR TO SOMEONE NOT IN YOUR TRUST?
Under the October 9 nationwide policy, ATF is no longer enforcing the covered NFA transfer and possession restrictions.
That means a legally eligible Texas resident can generally loan a suppressor to another legally eligible Texas resident, even if the borrower is not a member of the registered NFA trust.
The existing registration is not automatically canceled.
If a trust owns the suppressor, its trustees must still comply with the trust instrument and applicable state law.
Interstate loans may implicate separate Gun Control Act restrictions, including restrictions on transfers between residents of different states.
THIS IS AN ENFORCEMENT POLICY, NOT PERMANENT IMMUNITY FROM FUTURE ENFORCEMENT.
WHAT ABOUT TRAVELING WITH A SUPPRESSOR?
Under ATF’s current policy, it is not enforcing the covered NFA interstate-transport restriction for suppressors.
Suppressors generally do not require ATF Form 5320.20 for interstate transportation.
But destination-state laws still apply. Some states prohibit suppressor possession.
And do not confuse suppressors with short-barreled ri**es or sh****ns, which are subject to separate federal interstate-transport requirements.
WHAT ABOUT TEXAS LAW?
Texas generally permits suppressor possession by legally eligible individuals.
Texas HB 957, enacted in 2021, also addressed suppressors manufactured and remaining within Texas.
However, Texas legislation alone did not repeal federal law or prevent federal enforcement.
The October 9 federal policy is a separate and much broader development.
THE BIG LEGAL CATCH
ATF has NOT repealed the National Fi****ms Act.
Congress has NOT eliminated every federal requirement applicable to suppressors.
ATF has announced that it will not enforce specified NFA provisions under its current nationwide policy.
THAT POLICY CAN CHANGE.
The distinction between a court injunction, a statute, and an agency’s decision not to enforce a statute matters.
THE BOTTOM LINE:
✅ No $200 NFA tax.
✅ No mandatory NFA registration under ATF’s current policy.
✅ No mandatory Form 1 or Form 4 approval under that policy.
✅ No enforcement of NFA-specific maker’s engraving requirements.
✅ Nationwide application, not just GOA members or Silencer Shop customers.
❌ Dealer paperwork and background-check requirements have not disappeared.
❌ Applicable manufacturer markings and licensing requirements remain.
❌ Prohibited-person restrictions and state laws still apply.
NO NFA REGISTRATION DOES NOT MEAN NO FEDERAL FI****MS REGULATION.
Know the law BEFORE you buy, build, transfer, loan, or travel with a suppressor.
