For many New England families, the aging-in-place conversation eventually becomes:

Where will Mom or Dad live?

Stay in a house that’s becoming harder to maintain?

Move somewhere unfamiliar?

Move into an adult child’s home and give up some independence?

There may be another option worth investigating.

An ADU can put family close without requiring everyone to live under the same roof.

 🚨 SUNDAY ADU NEWS BREAK

MASSACHUSETTS’ ADU RULES ARE EVOLVING AGAIN.

And if you’re a homeowner, REALTOR®, builder, designer, lender or municipal official involved with ADUs, this is worth paying attention to.

On September 11, 2026, Massachusetts opened the public-comment period on proposed revisions to 760 CMR 71.00, the regulations governing Protected Use Accessory Dwelling Units.

The comment period runs through October 9, 2026.

Why does this matter?

Because Massachusetts isn’t simply talking about ADUs anymore.

THE MARKET IS ACTUALLY MOVING.

The state reports:

🏡 2,824 ADU applications

✅ 2,084 ADUs approved

And 854 approvals occurred during just the first six months of 2026.

That is an important distinction.

We have moved beyond:

“Will homeowners be interested in ADUs?”

The more relevant questions are becoming:

How do we make the process easier to understand?

How do municipalities implement the rules consistently?

How do homeowners determine whether their individual property is feasible?

How do we connect those homeowners with qualified professionals who understand ADUs?

Massachusetts has already added other pieces to that infrastructure this year, including an ADU homeowner incentive initiative focused initially on determining whether an ADU is right for a property, a statewide ADU financing program, and eight winners from its ADU Design Challenge.

THE BIGGER STORY?

ADUs are beginning to move from housing policy → actual housing production.

But 2,084 approvals also reinforce something we say constantly at The ADU Exchange:

LEGALIZING ADUs WAS THE BEGINNING. NOT THE FINISH LINE.

Homeowners still have to navigate feasibility, site conditions, utilities, financing, design, permitting and construction.

🚨 FACT OR FICTION?

“MY TOWN ALLOWS ADUs, SO I CAN BUILD ONE ON MY PROPERTY.”

❌ FICTION.

This may be one of the most important things a New England homeowner can understand about ADUs.

A law or zoning rule allowing ADUs answers only one part of the question.

It does not automatically mean your specific ADU idea works on your specific property.

Think of it this way:

PERMISSION ≠ FEASIBILITY

Your property still has a story to tell.

🏡 LOT & EXISTING HOME
Where could the ADU physically go?

📏 SITE CONDITIONS
Setbacks, access, topography and the location of existing improvements can affect the project.

🚰 WATER & SEWER
Municipal service, wells and connection possibilities need to be understood.

🛠️ SEPTIC
For properties relying on septic, the proposed additional living space may require a much deeper evaluation of the existing system and site.

🔥 BUILDING & LIFE SAFETY
A basement, garage or existing structure isn’t automatically suitable simply because it’s already standing.

⚡ UTILITIES
Electrical capacity, heating, plumbing and other infrastructure can materially affect the project.

📋 LOCAL REQUIREMENTS
State ADU legislation doesn’t erase every building, health, environmental or locally applicable requirement.

And then there is the question homeowners sometimes skip:

Does the project make financial sense?

An ADU can be legally permissible and still be impractical for the property, the homeowner’s goals or the available budget.

That’s why the first question shouldn’t be:

“Which ADU should I buy?”

It should be:

“What can this property realistically support?”

That question can potentially save homeowners from spending thousands of dollars pursuing the wrong design before understanding the site.

Most people don’t wake up one morning and suddenly need an aging-in-place solution.

It happens gradually.

The stairs get a little harder.

The house becomes more than you want to maintain.

Mom or Dad needs more help, but doesn’t want to lose independence.
