Department of State 90-Day Rule on F-1 OPT Students
Under this 90 day rule someone who files a change of status application to an H-1b within 90 days of entry into the U.S. runs the risk that the government will claim that the employee willfully misrepresented their intent at the time of entry in the U.S. The application for the change of status to an H-1b could be denied for this reason. If the H-1b application has currently been approved, there could be an issue in the future when the employee applies for the H-1b visa at the consulate, or could be denied an extension, or be refused entry to the US and/or denied a green card application. These rules are all based on whether the employee willfully misrepresents the nonimmigrant intent as a result of filing an H-1b change of status application within 90 days of entering the U.S. as an F-1 OPT student.
Due to this change in interpretation, it is strongly suggested that you contact your company HR and/or immigration attorney prior to any travel plans if your company intends to file an H-1b application this April 2018.

If your H1B application has been selected in the lottery and your OPT expires sometime prior to October 1, 2017 you qualify for the Cap Gap. Under the Cap Gap, your employment is automatically extended to September 30, 2017. If you qualify for the Cap Gap and would like to apply for the STEM Extension, you will need to do so within 90 days of the end date on your current EAD card. Once your STEM Extension I-20 is issued the start date will show October 1, 2017. If your H1B application is denied then you must contact the ISS office to have your Cap Gap notation removed from your SEVIS record. If your H1B is approved then your SEVIS record will automatically complete on October 1 and your STEM Extension will not be effective. Please consult with your company and immigration attorney to determine if you would like to apply for the STEM Extension. The ISS office cannot make this determination for you and does not provide immigration consulting in this regard. If you decide to apply for the STEM Extension, please submit the request form on the ISS website at http://iss.okstate.edu/request-opt-stem-extension. The recent Presidential Executive Order has left many people feeling confused and nervous. Please join the ISS Office for "Executive Order: Facts vs Fiction in the Face of Uncertainty" this Thursday February 9th at 6:30 pm in the Student Union Theater, 203 Student Union. The meeting will be presented by Doug and Matt Stump of Stump and Associates. The presentation will address the concerns on the Executive Order as well as other issues such as H1Bs, OPT and Travel.
