Chapter 135 (H.4885): Non-residents
Should not be taken as legal advice.
Non-Resident Licensing
• Antique Fi****ms - Creates a separate definition for “Antique Firearm”. Clarifies where a license is required to possess antiques/muzzle loaders. Any that use a modern primer or other ammunition component is considered a modern firearm and requires a license to possess.
• Strikes out “alien that resides outside the commonwealth” and replaces it with: a citizen or national of the United States or a person who maintains legal permanent residency.
• No longer exempt from licensing requirements for possessing handguns and any semi-automatic fi****ms for any purpose.
Non- Resident Hunting
• Must register their fi****ms with the Commonwealth prior to entering the state.
• Bans the possession of semi-automatic fi****ms (including rifles and shotguns).
• Bans any non-resident under 18 from hunting in Massachusetts.
• Non-residents, even those with a temporary license to carry, cannot purchase ammunition or ammunition part in the Commonwealth. (This has been the case since 1998, but was reaffirmed in Chapter 135.)
• Any muzzle loader that uses a modern primer or other component will be considered a modern firearm, thus a license is required.
• There is some language in line #1306 about hunting licenses: “The colonel of the state police shall determine those states with substantially similar requirements to those of the commonwealth for a firearm identification card under section 129C and a hunting license under section 11 of chapter 131 and shall annually publish a list of those states.”
Registration/Serialization
• Must register their guns prior to entering the state for any purpose other than travel.
• Must meet all of the new “serialization” standards.
• All fi****ms, frames and receivers shall have a serial number. Excludes pre-1968.
• Serial numbers must be placed in a manner not susceptible of being readily obliterated, altered or removed.
• Fi****ms, frames and receivers made from non-metallic materials shall be accomplished by using a metal plate permanently embedded in the material of the frame or receiver.
Storage and Transportation
• Must meet new storage/transportation standards upon entering in the state, other than for traveling through under certain conditions.
• Semi-automatics now fall in the Assault Style Firearm category only for storage/transportation.
Training
• Non-residents would likely have to travel to Massachusetts to take a course as it is unlikely to be taught anywhere else.
• It appears that if they currently hold a non-resident license prior to August 1, 2024 they are grandfathered for renewals only.
• The colonel of state police, in consultation with the municipal police training committee, shall create a new training curriculum. Must include at a minimum:
o Injury prevention.
o Su***de prevention.
o Disengagement tactics.
o Live fire.
o Completion of a written exam.
o Anything else they deem necessary.
• The colonel shall create a written examination and establish minimum requirements to pass.
• It appears that the state will send the certificate to successful students.
• Licensing authority must confirm with the state that a certificate has been issued prior to processing a license application.

Chapter 135 (H.4885) – Large Capacity Feeding Devices
The following should not be taken as legal advice.
Like all of Chapter 135, the “Large Capacity Feeding Device” (LCFD) laws are a mess. But here are a few things you should know. As usual, these interpretations are fluid and ongoing.
Restrictions on Possession:
Must have been lawfully possessed on, or before, September 13, 1994. (It does not specify possessed in Massachusetts, but the Attorney General will likely have a say in that.)
• On private property owned or legally controlled by the person in possession of the large capacity feeding device.
• On private property that is not open to the public with the express permission of the property owner.
• While on the premises of a licensed fi****ms dealer or gunsmith for the purpose of lawful repair.
• At a licensed firing range or sports shooting competition venue.
Mandatory Storage:
When not in use and traveling to and from the “permitted” locations they must be stored unloaded and secured in a locked container in compliance with the storage and transportation laws.
Transfers/sales:
It is unlawful to “import” any LCFDs into Massachusetts.
Transfers are limited to heirs, someone outside the State, or to a retailer. We have not yet found an exemption for retailers to transfer to persons inside the commonwealth.
Definition:
“Large capacity feeding device”, (i) a fixed or detachable magazine, belt, drum, feed strip or similar device that has a capacity of, or that can be readily converted to accept, more than 10 rounds of ammunition or more than 5 shotgun shells; or (ii) any part or combination of parts from which a device can be assembled if those parts are in the possession or control of the same person. “Large capacity feeding device” shall not include: (i) any device that has been permanently altered so that it cannot accommodate more than 10 rounds of ammunition or more than 5 shotgun shells; (ii) an attached tubular device designed to accept and capable of operating only with .22 caliber rimfire ammunition; or (iii) a tubular magazine that is contained in a lever-action firearm or on a pump shotgun.

CITIZENS’ POLICE ACADEMY STARTS SEPTEMBER 28, 2022
SALEM, MA.- The Salem Police Department will be offering a Citizens’ Police Academy starting on September 28, 2022 and will run for a ten (10) week period. The goal of the Citizens’ Police Academy is to offer insight into the Department as an organization, discuss current case law that affects policing today, and to give a general understanding of the day to day duties of a Salem police officer.
This ten-week course will cover topics such as patrol, fi****ms, search & seizure, crime scene, modern day police technology, use of force and other areas of interest. Topics will be taught by patrolmen and superior officers with particular expertise in the subject matter. Additionally, the Salem Citizens’ Police Academy will also host a “ride along” to participants who attend at least eight of the ten class sessions. This ride along allows students to “patrol” with officers during their regular tour of duty. Students will also be given an opportunity to utilize the department’s firing range under the supervision of a police fi****ms instructor.
The Citizens’ Police Academy will be held at the Salem police station on Wednesday evenings from 7 p.m. – 10 p.m. There is no fee for attending the Citizens’ Police Academy, and it is open to any Salem resident who is eighteen years of age or older. Class size is limited 25 students. Applications will available starting Tuesday August 30, at the Salem Police Department’s front desk, and online at www.salempd.net. In order to be considered for the class beginning on September 28, 2022 completed applications must be submitted no later than September 14, 2022.
