ATF made a big announcement today saying it is no longer enforcing portions of the NFA (suppressors/SBRs/SBSs). It also says that this does not circumvent state law. Under Wisconsin Statute 941.298, possessing a silencer/suppressor is a Class E felony unless the owner complies with federal NFA regulations. Because state law explicitly ties the legality of these items to federal NFA compliance, Wisconsin FFLs cannot transfer suppressors with only a 4473. We need to either eliminate that state law with the legislature or have a higher court strike it down. Unfortunately business as usual for us.

Just had an SBR Form 4 approval come back in less than 24 hours; submitted 5:35 p.m., came back at 10:00 a.m. Not too shabby

Unfortunately, all of this recent news doesn't seem to impact us in Wisconsin. Short of the State Legislature taking action and signed by the governor (extremely unlikely), Wisconsin state law still requires Form 4s for NFA items. A giant step forward for many people, but more legal work is needed.

Texas Federal Court: Part of the NFA Is “Gone” for Some

A federal judge in Texas ruled that certain NFA registration and approval requirements for suppressors, short-barreled ri**es, and short-barreled sh****ns exceed Congress’s authority now that the related federal taxes have been reduced to $0.

The ruling is a major win for plaintiffs including Gun Owners of America, the NRA, the Second Amendment Foundation, the Fi****ms Policy Coalition, the American Suppressor Association, Silencer Shop Foundation, SilencerCo, and Palmetto State Armory.

If you are a member of one of these plaintiff groups, the ruling may apply to you under the court’s order. However, the exact coverage depends on the group and the wording of the injunction, so members should wait for official guidance before taking action.

The decision does not eliminate the NFA nationwide, and the government could still appeal or seek to pause the ruling.

Better news: The ATF has official stopped caring about bump stocks.

ATF is removing the two sentences from its regulatory definitions of "machine gun" that included bump stocks. This directly implements the U.S. Supreme Court’s 2024 decision in Garland v. Cargill, which ruled that semiautomatic ri**es with bump stocks are not machine guns under the National Fi****ms Act. The change aligns ATF’s regulations with the statute and the Court’s binding interpretation.
