In the fight for Tribal digital sovereignty, who has jurisdiction over data, digital spaces and online governance? In May 2023, Montana enacted Senate Bill 419, aiming to ban TikTok within the state due to concerns over data security and content. However, this legislation raised significant issues regarding tribal jurisdiction. The Confederated Salish and Kootenai Tribes and the National Congress of American Indians filed an amicus brief with the U.S. Court of Appeals for the Ninth Circuit, arguing that the ban infringes upon Tribal sovereignty as the enforcement mechanisms could inadvertently apply to Tribal lands, where state laws do not have jurisdiction. At , experts will tackle the legal and policy battles shaping Tribal control over digital infrastructure—from state overreach to sovereign protections.
