Anyone else die a little inside anytime you agree to the Terms & Conditions because..what did I REALLY just agree to ¿🥴?

Clickwrap Agreements are digital prompts that offer a user the option to accept or decline a preset, digitally-mediated policy.

This take it or leave it type of agreement is called a *contract of adhesion*—a contract that lacks bargaining power, favoring one party over the other.

Where you’ve seen them:

👀 Signing up for social platforms
👀 Installing software on your computer
👀 Connecting to public wifi networks
👀 Other instances involving the end-user’s agreement for use of digital media

What your (most common) options are:

💡Click & Cringe ➡️ Accept at own risk

💡Reject or Decline ➡️ Just means you don’t get to use the product/service, sry!

💡Decline & Download ➡️ Dismiss the dialogue prompt & download a copy of the terms to look through later (giving you a chance to accept once you feel comfortable with everything the contract covers).

Go back and listen to our podcast with now Federal Public Defender, James Rael. If your county doesn’t have low case loads for PDs, go fight for it on their behalf!! It makes the whole system better.

I was trying to explain how the court system works to my fiancé the other day and quickly realized that a diagram would have been useful!!

Note: this is just the federal courts breakdown. Stay tuned for state courts and the interaction between the two systems (AKA federalism at work ~ now is a good time to listen to our federalism podcast if you haven’t yet!)

People have legal questions all the time even without realizing they are legal in nature. Our goal is to raise the legal literacy of this country so that we can better engage in our communities, elevate our businesses, and become equip to answer some of the legal questions that come our way.

What are some situations you’ve come across that required a bit of legal lit? Tell us in the comments!

Tor’s answer: I started my photography business when I was an elementary school teacher. I had never taken a business or legal course. So, when my friends said “you need an LLC,” I hired somebody to make me an LLC. I wasn’t sure what it truly meant in regard to taxes, liability, business organization and ownership, etc. I wish I had a basic understanding of business organizations so that I could have asked my limited-representation attorney better questions.

One of the changes RIPE.] is making is categorizing substantive content into these four important categories while continuing to build our resource database.

(1) Government & civics will include things like constitutional law, civil and criminal procedure, …
(2) business & economics will include topics like contracts, sports, intellectual property, …
(3) health & human rights will include things like healthcare and employment
(4) interpersonal governance will include topics such as torts and family law.
