The Treasury Department offered a glimpse this week of how the new federal school choice tax credit will work, giving educators and policymakers insight into the program.
The American Federation for Children, which sent two representatives to a roundtable hosted by the IRS and Treasury Department Tuesday, said the new guidelines give βevery governor in every state the clarity they need to opt in immediately.β
βThe guidance released today made clear what families and education leaders have known since the law passed: the EFTC benefits children across educational settings β public, private and even homeschool in some states,β the federation said Wednesday in a release. βTreasury will also issue clear rules to prevent misspending. With 31 states already opted in or signaling intent to do so, the remaining holdout governors must act now.β

Though 74%+ of Maryland Democratics support OPTING IN to the EFTC, the Maryland State Education Association says, "don't do it" while the Maryland Association of Christian Schools rallies for it.
In their June 5th statement, the MSE asserts that this brand new federal tax credit undercuts public school funding. We should also recall that local and state funds cover 90% of the public school budget, not the federal. The MSEA Executive Director does not mention that scholarship granting organizations may benefit public school students just as much as private school students should the SGO be setup to do so. He also does not seem to represent the 70%+ of MD Democrats, as outlined in the Center for Excellence in Polling's November 2025 Maryland Education Poll, who SUPPORTED this measure.
Does MSEA really want money to flow out of the state to the harm of the families within it just so that ? Estimates are that between $250,000,000 and $500,000,000 will simply leave the state as people choose to send their $1,700 to SGOs in states which opt in rather than to the federal government. Why shouldn't that money stay in MD?
Perhaps the Democrats for Education Reform can reach out to MSEA and have a conversation as the DFER has been supportive of seeing other largely blue states make good decisions concerning education?
