📜 Virginia Parents: Lesson Plans Are Public Record.

A 2026 Virginia Freedom of Information Advisory Council opinion (AO-02-26) confirmed: lesson plans are NOT automatically private. Schools must disclose them when requested — with only personally identifiable student info redacted.

Why this matters for IEP families:
✅ You can request lesson plans to verify your child's instruction matches their IEP
✅ Schools cannot use a blanket 'scholastic records' claim to hide curriculum
✅ Copyright is NOT an automatic shield — schools must evaluate fair use
✅ Redact student details. Release the rest.

Don't accept blanket denials. FOIA requires schools to justify withholding.

📂 Know Your Rights Under FERPA.

The Family Educational Rights and Privacy Act (FERPA) is a federal law that protects the privacy of your child's education records — and gives YOU the right to access them.

Under FERPA, you have the right to:
✅ Inspect and review your child's education records
✅ Request corrections to records you believe are inaccurate
✅ Consent before the school shares records with outside parties
✅ File a complaint if the school violates your rights

This applies to IEPs, evaluations, disciplinary files, emails — all of it.

If a school has ever told you that you can't see a record related to your child — that may not be accurate.

📖 Federal Law You Should Know: The Every Student Succeeds Act (ESSA)

ESSA replaced No Child Left Behind as the primary federal K–12 education law. It applies to ALL students — including those with disabilities.

Key ESSA protections for special needs families:
✅ Schools must include students with disabilities in state assessments
✅ Results must be publicly reported — meaning you can see how students with disabilities are performing in your district
✅ States must identify and support low-performing schools, including those failing students with disabilities
✅ Parents have the right to know about teacher qualifications in Title I schools

📢 Hampton Roads Has 800 Open Teaching Positions — And Special Education Is Among the Hardest Hit.

According to recent reporting from WHRO, Hampton Roads schools have approximately 800 open teaching positions — with the largest gaps in elementary and special education.

What this means for families:
⚠️ Special education classrooms may be understaffed or covered by substitutes
⚠️ Related services may experience delays

As the new school year begins, take these steps NOW:

✅ Request a copy of your child's current IEP in writing
✅ Review goals — are they measurable? Do they reflect your child's actual needs?
✅ Confirm which services are listed AND how often they'll be delivered
✅ Ask the school to confirm staff assignments before the first day
✅ If your child's school changed (rezoning or closure), request an IEP meeting
✅ Request evaluations now if you believe new needs have emerged

📚 Know Your Rights: What Is IDEA?

The Individuals with Disabilities Education Act is the federal law that guarantees children with disabilities the right to a Free Appropriate Public Education (FAPE) in the Least Restrictive Environment (LRE).

Under IDEA, your child is entitled to:
✅ An IEP tailored to their unique needs
✅ Related services like speech, OT, or PT — at no cost to you
✅ Placement in the setting most like their general education peers

⚠️ Facing Suspension or Discipline? Your Child May Have the Right to an MDR.

A Manifestation Determination Review (MDR) is a legally required meeting under IDEA. It must take place before certain disciplinary actions are taken against a student with a disability.

The team must answer one critical question:
Is your child's behavior connected to their disability?

If YES:
🔹 The school cannot proceed with suspension as written
🔹 The IEP team must conduct a functional behavioral assessment
🔹 A behavior intervention plan must be developed or revised

If NO:
🔹 Standard disciplinary procedures apply — but IEP services must continue
