Emergency Action Plan Requirements for Maine Businesses
In Maine, most businesses are required to have an Emergency Action Plan (EAP) if they have 10 or more employees. The Maine Department of Labor states that workspaces must have an EAP to ensure employee safety in case of an emergency, and companies with 10 or more employees must have it in writing www.maine.gov.
OSHA Requirements
Under 29 CFR 1910.38, an employer must have an EAP whenever an OSHA standard requires one. The plan must:
Be in writing and kept in the workplace, available for employee review.
Include procedures for reporting emergencies, evacuation (including exit route assignments), accounting for all employees after evacuation, and roles for those remaining to operate critical operations.
Designate and train employees to assist in safe evacuation.
Maintain an employee alarm system with distinctive signals.
Be reviewed with employees when the plan is developed, when responsibilities change, or when the plan is updated Occupational Safety and Health Administration+1.
Employers with 10 or fewer employees may communicate the plan orally, but it still must be available to employees Occupational Safety and Health Administration.
