45 Q Implementation December 2019 Update – CO2 Conference 02/20/2020

February 19, 2020 the IRS issued two important guidance documents to help implement the Section tax credit, which incentivizes and storage projects. The IRS has provided significant guidance today to allow development of many projects to move forward. We will now be able to appropriately structure partnerships so that tax credits can end up in the hands of the right partners. In addition, the IRS has provided substantial flexibility in how a project can begin construction prior to the deadline, and an expanded deadline for when a commenced project must be operational. While this guidance comes over two years after was revised, it is certainly welcome news to the industry.

45Q has been a topic of great interest at the CO2 Conference Carbon Management Workshop for the past few years.
