As we reflect on the U.S. Independence Day today, there may be more to celebrate when we think of independence. The practice of mediation can feel lonely and isolating, as we need to maintain our neutrality and the work that we do is solitary, behind closed doors, and confidential. But what most mediators tell us is that they relish the freedom and independence that comes with being a professional neutral - no partners, no bureaucracy, no clients, we manage our own calendars, we work with who we want to, and we get to help people resolve conflict every day. For those of you who are already practicing as mediators, we are here to help you raise your level of mastery and get more out of that experience. As humans, we have the capacity to take in much more information during a dialogue than we typically do. As mediators, we need that information to give us an edge, both within our mediations, and also in the marketplace. In this workshop, we will examine the ways that we mediators can enhance our intake of the sights and sounds going on in front of us. Experienced mediators will use this additional information in mediation sessions, and also when networking and interacting with potential clients. In addition, we will spend some time on how mediators can maximize their personal power in these same settings – including how to have more impact, be heard and understood better, and leave a stronger leave-behind after an interaction. "Impasse is a Fallacy"
This presentation challenges the concept of "impasse" in mediation, suggesting it's often a myth or bluff rather than a true dead-end. It explores how mediators can avoid or overcome impasse by managing the process more effectively from the very beginning. By examining the five stages of mediation—from convening to final agreement—the session offers practical strategies for anticipating and addressing roadblocks before they become impasses. Participants will gain tools to enhance their mediation outcomes and increase settlement rates, reframing impasse not as failure, but as a call to creativity, persistence, and proactive process management.

This interactive workshop helps mediators expand their skillsets by exploring a single business dispute through four distinct lenses: legal/risk analysis, psychological/relational, practical/business, and creative problem-solving. This On Demand course is a recorded version of our entire 40-hour live course, comprised of 21 videos, each between 1 and 2 hours long. This program is a practical training course. While covering theory to give you a framework and the intellectual understanding of negotiation and mediation, this course is about practical application, with lots of real-world examples from a very active mediator who uses these skills in the trenches every day. The role play simulations are realistic, often real world, cases. In this course you will learn how to be a complete mediator. Some training programs specialize in teaching a particular method, theory or approach. This course will give you experience with all of the different styles and approaches that complete mediators call upon. Advocates and party representatives will learn how well-equipped mediators think and how to be most effective in negotiating their own cases. This course also covers the entire mediation process, from getting people to the table with the right mindset to how the mediator runs the process to the negotiation stage with both competitive and collaborative negotiation styles and game theory, to closing the deal and overcoming what might appear as an impasse. This course meets the educational requirements of most court mediation programs and most panels requiring a 40-hour mediation training. More importantly, it will prepare you to be a successful mediator – helping the parties settle cases that they never thought could.
