A message from our Executive Director, Grahame Jones, regarding a new U.S. Fish and Wildlife Service directive that changes how the agency will interpret and enforce protections under the Endangered Species Act:

For decades, the Endangered Species Act has provided a critical backstop for wildlife at greatest risk. This new enforcement memo represents a significant shift from the agency’s longstanding approach to what constitutes an unlawful “take” of a protected species.

For the most part, industry and development have understood these guardrails and learned to work within them, in part because of the risk and liability associated with noncompliance. When those guardrails weren’t followed, an enforcement process was in place to address those situations appropriately.

We are concerned this narrower interpretation could reduce those protections when harm occurs as an incidental result of other activities.

As our population grows and demands on our oceans, rivers, bays, estuaries, wetlands, wild places and wild things increase, we should be moving in the other direction — adding value and protections, not moving away from the principles that have guided how we value wildlife and protect species most at risk.

The next generation will inherit the consequences of the decisions we make today.

Please contact the U.S. Fish and Wildlife Service Director Brian Nesvik, your U.S. Senators and members of Congress and let them know how you feel about this significant change. Thank you.
