A manifestation determination is not just a formality before a suspension.

Under 34 CFR 300.530(e), it must happen within 10 school days of a decision to change a student's placement for a code of conduct violation.

The team then asks two things.

Was the behavior caused by or directly and substantially related to the disability.

Or was the behavior a direct result of the school failing to implement the IEP.

If either is true, the behavior is a manifestation.

I.D.E.A. sets this floor. Always confirm your district's exact process with your special education coordinator/coach/mentor/director.

Special education is not a room.

It's not a place a student gets sent to for part of the day.

It's a set of services built around what that specific student needs to access their education.

Federal law requires students be educated alongside their nondisabled peers to the maximum extent appropriate.

Removal only happens when the nature or severity of the disability means general education, even with supports, isn't enough.

That's not a school preference. That's I.D.E.A.

So next time someone talks about a student like special education is a room they go to, here's your gentle reminder: it's a service that student receives, not a place they're sent.

Have you heard of The Blue Envelope Program? It may be worth looking into if you or someone you love is autistic, has a disability, communicates differently, or may feel overwhelmed during a traffic stop.

The program is designed to help make interactions between drivers and law enforcement clearer, calmer, and safer by giving drivers a simple way to share important documents and communication information.

Even if your loved one is not the driver, this may be a helpful reminder to think through what information first responders may need to understand and support them during a traffic stop, crash, or emergency.

Tools like this can help reduce confusion, support safety, and give families one more way to prepare for situations that may feel stressful or unpredictable.
