Attention LMU Moot Court Alumni!

LMU's Moot Court Board has decided to start the process of structuring tryouts like a real competition. We are creating the intramural competition in honor of LMU alumnus Matthew B. Long who passed away in 2019 and we have created a problem that reflects areas of law Mr. Long specialized in.

The 1st Annual Matthew B. Long Moot Court Intramural will be held on Saturday, April 15th starting a 1:00pm. There are 4 rounds and we anticipate 1-hour blocks per round (although each oral & feedback should last approximately 30 minutes). If any of you would be available to sit on a panel and judge, we would greatly appreciate your help! We are in need of judges for preliminary rounds; however, if another time slot works best four your schedule, we will still love to have you.

The anticipated schedule is as follows:
Preliminary Rounds - 1:00pm -2:00pm
Quarterfinals 2:00pm - 3:00pm
Semifinals 3:00pm - 4:00pm
Finals 4:00pm - 5:00pm

In addition to our Bankruptcy team, we sent another team out to compete this weekend. Meet our 2023 ABA NAAC teams!

This week, we sent our two oralists (Ryan and Daryl) as well as our brief writer (Kelli) to New York to compete in the Duberstein Bankruptcy Moot Court Competition.

Daryl's issue is whether a bankruptcy court has the jurisdictional authority to confirm a Chapter 11 plan of reorganization that includes nonconsensual third-party releases. The issue requires a discussion of bankruptcy jurisdiction under the United States Code and as it has been limited by Supreme Court decisions based on Article III of the United States Constitution. It also involves issues of due process and notice.

Ryan's issue is whether recent revisions to the Bankruptcy Code expanded the law for Chapter 11 business debtors who file under Subchapter V concerning the dischargeability of debts. Certain long-standing Code provisions make it clear that exceptions to discharge under the Code apply only to individual debtors; however, the language chosen by Congress for discharge in Subchapter V cases is not clear, and there is a conflict of authority concerning whether Congress intended to expand the nondischargeability provisions to include both individuals and corporate debtors who file under Subchapter V.

Meet our second team for the semester, the Regent team! They will be competing at Regent's 22nd Annual Leroy R. Hassell Sr. National Constitutional Law Moot Court Competition in Virginia Beach, VA!

Team Members: Meganne Lee (Brief Writer), Victoria Small (Oralist), Nathan Webb (Oralist), and Judge Timothy Conner (Coach).
