UNDERSTANDING VA MATH

Many veterans believe:
👉 50% + 50% = 100%

❌ That is NOT how the VA calculates disability ratings.

The VA uses what’s called the “Whole Person Theory.”

They start with the assumption that a veteran is 100% healthy, and each condition is calculated from the remaining healthy percentage — not added together directly.

Step-by-Step VA Math Formula

1. Starts with your highest rating first

2. Subtracts that percentage from 100%

3. Applies the next rating to the remaining percentage

4. Continues until all conditions are calculated
Rounds to the nearest 10%

Example: Veteran is has the following ratings:
PTSD = 70%
Tinnitus = 10%
Back Condition = 20%

Step 1 — Highest Rating First
Start with PTSD at 70%.
100 - 70 = 30

The veteran is considered:
70% disabled
30% “healthy”

Step 2 — Apply the 20% Back Condition
The 20% is taken from the remaining 30%.
0.20 x 30 = 6

Now calculate:
70% + 6% = 76%

The veteran is now considered:
76% disabled
24% healthy remaining

Step 3 — Apply the 10% Tinnitus
10% is taken from the remaining 24%.
0.10 x 24 = 2.4

Now calculate:
76 + 2.4 = 78.4

VA rounds:
78.4% → 80%

Final Combined Rating: 80% ✅

⚠️ This is why many veterans get stuck at 90% ⚠️

Many veterans think since they are at 90%, they only need another 10%.

That is NOT how VA math works.

At 90%, the veteran only has 10% “healthy” remaining.

So another 10% condition becomes:
0.10 x 10 = 1
Meaning:
90% + 1% = 91%
Still rounds to 90%
Final Combined Rating: 90% ✅

Key Takeaway
VA math is based on “Percentage of the remaining healthy body”

That’s why 50% + 50% ≠ 100%. It equals 75%.

Your VA claim wasn’t denied… but it also wasn’t approved. So what does a DEFERRED claim really mean?

A deferred claim is NOT a denial. It simply means the VA needs more information before making a decision.

🚧 “Deferred claim = the VA hit pause. Here’s some common reasons a VA claim gets deferred:

🔍 1. The VA Needs More Medical Evidence
The VA may still be waiting on:

VA medical records
Private treatment records
Service treatment records
DBQs or nexus opinions

📌 Example:
A veteran claimed migraines, but the VA still needs neurology treatment records before making a decision.

🩺 2. The VA Orders Another C&P Exam
Sometimes the first exam was:

Incomplete
Contradictory
Missing important information
Not sufficient for rating purposes

📌 Example:
The examiner diagnosed a mental health condition but failed to provide a medical opinion linking it to service.

⚠️ 3. Duty to Assist
The VA has a legal obligation to help gather evidence needed to decide the claim.

📌 Example:
The VA is waiting to receive requested military or private medical records on your behalf.

📄 4. Clarification Is Needed
The rater may need clarification from:

The examiner
Medical providers
The veteran

📌 Example:
The examiner noted knee pain but did not explain flare-ups or range of motion limitations.

🧪 5. Waiting on Specialized Opinions
Some claims require:

Toxic exposure opinions (TERA/PACT Act)
Mental health opinions
Secondary service connection opinions
These often take additional time.

📌 Example:
Sleep apnea claimed secondary to PTSD may require another medical opinion.

📅 6. The VA Is Separating Conditions
Sometimes the VA can decide some conditions now while delaying others.

📌 Example:
Tinnitus approved
Migraines deferred
Sleep apnea deferred

In many cases, it means:

➡️ The VA is still actively working the condition

➡️ More evidence is being gathered

➡️ Another opportunity exists to strengthen the claim

⏳ Deferred claims can sometimes lead to approvals once development is completed.

👉 Bottom line: A deferral = more development, not the end of your claim.

TWO COMMON VA APPEALS

Don’t agree with a VA decision? Two common options to consider is filing for a Higher-Level Review or a Supplemental Claim with the VA. Not every denied VA claim should be appealed the same way. Choosing the correct lane can make a major difference in your outcome.

🔵 HIGHER-LEVEL REVIEW (HLR)
📄 Filed on VA Form 20-0996

Choose this when:
✔️ You believe the VA made an error
✔️ The evidence is already in your file
✔️ You are NOT adding new evidence

A senior VA reviewer takes another look at the same records and decision.

💬 Veterans also have the option to request an Informal Conference to explain where they believe the VA made a mistake.

📌 Example:
You submitted a strong nexus letter and medical evidence, but the VA overlooked the evidence or incorrectly applied the law.

➡️ HLR may be the better option because the evidence already exists in your file.

🔴 SUPPLEMENTAL CLAIM
📄 Filed on VA Form 20-0995

Choose this when:
✔️ You have NEW and RELEVANT evidence
✔️ You need to strengthen your claim
✔️ Important records or medical opinions were missing

This allows you to submit additional evidence for the VA to reconsider the claim.

📌 Example:
You were denied for migraines, but now you have:
• A new diagnosis
• Buddy statements
• A nexus letter
• New treatment records

➡️ A Supplemental Claim may be the stronger route.

⚠️ KEY DIFFERENCE:
HLR = No new evidence allowed
Supplemental Claim = New evidence submitted

⏰ Veterans generally have 1 year from the VA decision date to preserve the earliest possible effective date.

🚨 The VA Disability Intent to File Date Matters More Than Most Veterans Realize 🇺🇸

One of the biggest mistakes veterans make is waiting too long to submit their Intent to File.

Why does this matter?
Because that date can determine how much BACK PAY you receive once your claim is approved. 💰

An Intent to File tells the VA that you plan to file a claim.

Once submitted, it can protect your effective date for up to ONE YEAR while you gather:

✅ Medical evidence
✅ Personal statements
✅ Nexus letters & DBQs
✅ Buddy statements
✅ Supporting documentation

Here’s an example 👇
A veteran files an Intent to File in January but doesn’t officially submit the claim until July.

If the VA later grants the claim, compensation could be paid back to JANUARY — not July.

This is why filing your claim within the year of your Intent to File is important.

That difference could mean THOUSANDS of dollars in retroactive pay.

Too many veterans wait until everything is “perfect” before taking action and unknowingly lose months of potential compensation they earned through service.

⚠️ File the Intent to File FIRST.

Then build the strongest claim possible.

That one date can change everything.
