The Supreme Court ruled in favor of Rudisill in Rudisill v. McDonough. In this case, the court held that servicemembers who accrue educational benefits under the Montgomery and Post-9/11 GI Bills through separate periods of service may use either one, in any order, up to the 48-month aggregate-benefits cap per 38 U.S.C. § 3695(a).

Student Veterans of America (SVA) has been tracking this case's developments, as it can impact many current and furture student veterans. In August 2023, SVA submitted an Amicus Brief supporting the veteran before the Supreme Court proceedings later that year. The Amicus Brief can be found: https://nam12.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.supremecourt.gov%2FDocketPDF%2F22%2F22-888%2F275570%2F20230817141452648_Br%2520of%2520Amici%2520NVLSP%2520et%2520al.pdf&data=05%7C02%7Ckameron.smith%40studentveterans.org%7C3e5a1efcdcc64a9abc8a08dc5e5d7610%7C471af39fe4d34b029100e93671790248%7C0%7C0%7C638489002729240949%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C0%7C%7C%7C&sdata=QHihxjKzb%2FgARJTveoCFZgLGw9lV6s%2Fgk0hz6yDwNho%3D&reserved=0

SVA is actively engaging with the VA. VA’s Office of General Counsel, along with VA Education Service staff, is reviewing the decision. They will assess the impacts and provide guidance to veterans, veteran service organizations, and other stakeholders. Stay tuned for more information in the coming days.

Education benefits.

Supreme Court gives some military veterans more generous educational benefits The court ruled 7-2 that the Department of Veterans Affairs improperly calculated the educational benefits for James Rudisill, a retired Army captain who lives in northern Virginia. Rudisill, who's now an FBI agent, is in a category of veterans who earned credit under two versions of the G.I. Bill.
