How state constitutions became the battleground for American rights and liberties – on both the left and right State constitutions play a growing role in American politics. But turning to such documents to recognize rights and liberties is not a new project – nor is it an entirely liberal one.

The Uniform Law Commission has approved the Uniform State Indian Child Welfare Act, the first major effort to update ICWA's 1978 standards for today's legal practice. Kathryn Fort, director of MSU Law's Indian Law Clinic, served as reporter for the drafting committee, leading a four-year process to reorganize and strengthen protections for Native children and families. In this Ask the Expert conversation, Fort discusses what the Act changes, how it supports states without their own ICWA laws, and what she hopes comes next.

MSU Law is launching the Leaders in Law series, bringing four of the nation's most influential legal thinkers to campus during the 2026-27 academic year to examine one of the nation's enduring questions: How does the Constitution continue to shape American democracy?

The series opens September 1 with Cecillia Wang, National Legal Director of the ACLU, who recently argued a landmark birthright citizenship case before the U.S. Supreme Court. She'll be followed by NYU's Richard Pildes, Yale's Harold Koh, and University of Michigan's Barbara McQuade, each bringing a distinct lens to the questions shaping American law today.
