Here's the truth: When it comes to electronic notarizations, there is no one-size-fits-all answer in the United States. What's perfectly legal in Texas may not be permitted the same way in California. What's required in Florida may differ from what's required in New York.
This is why "I saw it on social media" is never a safe standard for your notary practice. π
π Let's break down the basics:
π· eNotarization (Electronic Notarization)
Same as a traditional notarization β the signer is physically in front of you β but documents are signed and sealed electronically instead of on paper. Think digital signatures and e-stamps instead of ink and embossers.
π· RON (Remote Online Notarization)
The signer is NOT physically present. Instead, you meet face-to-face over a live, approved audio-visual platform. Identity is verified through knowledge-based authentication (KBA) and credential analysis. Everything is completed and stored digitally.
β οΈ Here's where notaries get into trouble:
β Assuming RON is legal in their state without verifying
β Using a non-approved RON platform
β Skipping required training or state registration for RON

Here's something that really gets me though... I can't tell you how many times I've performed the verbal ceremony and a new client says "I've never heard that before." And honestly? That concerns me. π
π©π½βπ« As a notary instructor, this is something I stress EVERY single time β the verbal ceremony is not optional, it's essential! There are 5 notarial acts, and each one has its own verbal ceremony. It's the most reliable way to confirm that your signer is:

This one is non-negotiable. Full stop.
We know how it goes. A client calls and says:
"My husband already signed it β can you just stamp it?"
"She's in the car, can we just do it real quick?"
"It's for my elderly mom, she trusts me completely."
And your heart wants to help. We get it.
But here's what's at stake when you notarize without the signer present:
β You have no way to verify the signer's identity
β You cannot confirm they signed willingly and without pressure
β You cannot assess whether they understand what they're signing
β You could be unknowingly participating in fraud
And the consequences? They are serious.
β οΈ Loss of your notary commission
β οΈ Civil liability
β οΈ Criminal charges in some states
No job, no client relationship, no amount of money is worth your commission, your reputation, or your freedom.
The signer MUST appear before you β in person or via approved remote online notarization (RON) β at the time of notarization. That personal appearance is the entire point of what we do.
