Buried inside 600+ pages of Pennsylvania’s state budget: a repeal of the 1929 law that let traditional midwives legally practice.

Midwife isn’t one credential. Nurse midwives (CNMs) work in hospitals. Certified midwives (CMs) are medically trained but need a collaborating physician. CPMs are certified to attend home births independently. Traditional or lay midwives are uncertified, trained through community apprenticeship, serving Amish and Mennonite families and others who choose birth choice and birth freedom over the default hospital pathway.

It’s this last group, the ones actually delivering most home births in PA, whose legal footing just disappeared.

The 1929 law had gone unenforced for decades. Repealing it doesn’t restore order, it removes the only legal footing traditional midwives had left, right as a lawsuit over midwife regulation was already working its way through the courts.

Some lawmakers say they didn’t even know they’d voted for it. That’s what birth freedom under threat looks like: quietly, in a budget bill, with almost no public debate.

A judge rules tomorrow, Wednesday, August 5, on whether to block the new law. The hearing is open to the public at the Commonwealth Court of PA in Harrisburg, 10 AM. Come observe. This is a courtroom, not a rally, so stay respectful and let the case speak for itself.
