🧿 How can you detect a fake OSHA Card?

I thought that I would write a short article regarding a subject that I hope will help protect the hard-working folks out there and their hard earned dollar! If you live in the New York City area, you are well aware that it is a requirement to have OSHA training to be able to work on any job that requires a licensed NYC Department of Buildings Construction Superintendent, Site Safety Coordinator, or Site Safety Manager. This training supplements the other Local Law 196 required classes to obtain a Limited Site Safety Training Card, Full SST Card, or the 62-Hour Supervisor SST Card. OSHA training may also be a requirement of the owner, agency, or any AHJ (authority having jurisdiction) in your area.

For various reasons this has led to some fake OSHA cards being produced. This is not breaking news in any way. We have all seen the news reports of fake OSHA cards being produced not only in New York City but everywhere. This is one reason for the new design of the OSHA outreach training cards in Construction, General Industry, Maritime, and Disaster Site Worker. It was helpful to add the QR code to help validate the training. Here is a question to ponder though: If someone can produce a fake card with QR code, don't you think that they can produce a fake website to communicate a fake positive validation of the card? I have heard this to be true. What do you do then? You go to the source. With the potential of being fined upwards of $5,000.00 in NYC for having someone working on site without an OSHA card or a fake one, it would be worth the time to be sure. And this can be curtailed by the NYC Chapter 33 Building Code 3321.2 requirement to fill out daily training logs. I have noted below some of the websites that are the "source" to validate OSHA cards you may come across:

For those who are going for an OSHA training in person, here is an important tip: ASK to see their "OSHA Authorized Trainer" card. This will potentially save you from a bad situation. I recently went for my OSHA 502 so that I could renew my status as an OSHA Authorized Construction Trainer. They told us that we need to show this card at the beginning of teaching the OSHA 10 or 30 class. So I would recommend that you don't continue in the class unless you see this card from the instructor. I could imagine the kick in the gut feeling that you would feel if you just paid your hard earned money for a class and don't receive a real OSHA 10 or 30 card. Another thing that you can do before you organize or attend a class is go to the OSHA.gov website to see a list of trainers for your area. This will give you the peace of mind that your are talking to a real authorized outreach trainer. OSHA's website also gives you a list of the limited number of online companies that do provide the OSHA outreach training. Be sure to use one of them if you do go that route.

βœ… WHAT IS AN SST CARD IN NYC?

An SST card (sometimes called SST certification) is proof that someone has completed the safety training required for construction and demolition workers on certain job sites by the New York City Department of Buildings (NYC DOB).

βœ… WHAT DOES SST STAND FOR?

SST stands for Site Safety Training.

βœ… ARE THERE DIFFERENT TYPES OF SST CARDS?

Yes, but most of them are no longer relevant. Site Safety Training cards were put into place by Local Law 196, passed in 2017. The law provided for a phase-in period that included Temporary and Limited SST cards by certain deadlines.

The transition period ended on March 1, 2021, however, so now everyone needs a full SST card. Workers with certain supervisory responsibilities need a 62-hour SST Supervisor card. Everyone else needs a 40-hour SST Worker card.

βœ… WHO NEEDS SITE SAFETY TRAINING?

The NYC DOB now requires construction and demolition workers to obtain an SST card and 40 hours of DOB-approved Site Safety Training. Without an SST card, they will not be permitted to work at any construction site in New York City with a Site Safety Plan. All construction sites with a Site Safety Plan must meet Local Law 196 training requirements.

βœ… WHAT IS NEW YORK CITY LOCAL LAW 196 OF 2017?

Local Law 196 of 2017 requires that construction workers and supervisors at most major worksites in the five boroughs receive additional safety training. It applies to all NYC construction sites with a Site Safety Plan and a designated construction supervisor, site safety coordinator, or site safety manager.

βœ… HOW DO NYC CONSTRUCTION WORKERS STAY COMPLIANT?

NYC workers must complete 40 hours of Site Safety Training to earn an SST Worker card (supervisors need 62 hours). This can be accomplished through any DOB-approved training provider.
