IEP Tip: if your child is turning 3 and the receiving district denies eligibility, be very strategic in how you respond. If a district can not collect data because kiddo would not adhere to standardized testing, that is data in itself. The experts of a kiddo under 3 are parents and EI. EI should speak to any presentation and testing. If not- district can choose to not accept EI testing. Parent always has a right to an IEE. It could and will delay services, so put in writing disagreement and ensure you have outside providers who will support. Only 69% or less of kiddos in part C will qualify for Part B services. Be smart and sadly also strategic and remember qualifying for EI is very different for qualifying for special education.
