The Texas DPS PSB has finally stated that the carrying of rifles by a Commissioned Security Officer or a Personal Protection Officer is PROHIBITED.

Those in violation will face a $500 fine for the first offense, with subsequent offenses ranging in a fine of up to $1,000, suspension, or revocation of their license.

H.B. 3424 is an amendment to the Occupations Code in the state of Texas, specifically related to the eligibility and training requirements for commissioned security officers and personal protection officers. The bill has been signed off by the Texas House and Senate. It has been sent to the Governor’s desk to sign. Here is a summary of the key provisions:

• Persons submitting an application for a Level 3 license or Level 3 license renewal on, or after January 1st, 2024, must submit proof of completion by and the results of the Minnesota Multiphasic Personality Inventory (MMPI) test. The commission [PSB] is authorized to establish the Minnesota Multiphasic Personality Inventory (MMPI) test as a requirement for Level 3 applicants to evaluate their psychological fitness.

• “Self-defense tactics” has been added as a requirement for the Level 3 training course. The fi****ms and self-defense portion must be 10-15 hours of IN-PERSON instruction WITH AN ON-SITE LEVEL 3 INSTRUCTOR. PSB must change the course to reflect these requirements so the Level 3 course may, or may not, have more hours added onto it. The new Level 3 training course must be updated by PSB no later than January 1st, 2024.

• The Level 4 training course must now be provided IN-PERSON.

Apparently Austin city council has eliminated the DWI unit, Gang Unit, Forensics, special investigations, and park services. Crime waves are spiking with murder rates that climbing up to 200% as of September 2021.

Those in the private security industry in Austin may have to re-evaluate their arrest and engagement policies if the police likely won’t be showing up for them.
