(yes I changed the hashtag) no. 2: (One of) our illustrious Co-President(s), Matt! Matthew is a 2L and Co-President of Outlaws He is from Ypsilanti, Michigan. He studied International Studies and Arabic at Texas A&M University. Prior to Law School, Matthew taught third grade government in San Antonio, Texas with Teach For America. When the casebooks close for the evening, he unwinds with his pet corgi and a good book. Matthew is working at Morgan, Lewis & Bockius as a 1L Summer Associate and Diversity Fellow in the Houston office.

Nate is a 2L and the current Communications Chair. He grew up all over, but mostly in the next town over of Saline, MI. He spent three years working as a geologist after graduating from the University of Notre Dame before returning to Michigan to for Law School. When not deep in the books, he enjoys camping, strategy games, and pretending he’s a professional chef! Edibility not guaranteed.

Huge shout out to our pro bono chair Chloe Roddy for all the work she has done this year!

This just in! A Michigan court just ruled that a "Medicaid provider's written policy excluding all [transgender medical services] from coverage is a violation of federal law". Shout out to the Outlaws at the University of Michigan and JTCC's Know Your Rights Project! The case isn't over yet, but this is a big step in the right direction.

Monthly Know Your Rights Bulletin from the Outlaws at the University of Michigan and JTCC's Know Your Rights Project:

Q: My same-sex spouse and I are both listed as parents on our child’s birth certificate here in Michigan. Does the non-birth parent automatically have parental rights? Do we need to adopt for her to have parenting rights?

A: At birth, a child’s birth certificate in Michigan has spots for “mother” and “father”, but same-sex couples can also request “parent” and “parent” designations. Regardless of the parental designation, if a parent’s name is on the birth certificate the parent has enforceable parental rights over the child, including in the case of a divorce between the couple. Earlier this year, the Supreme Court reiterated that Obergefell v. Hodges required states to provide the same benefits to same-sex spouses when a child is born, as provided to heterosexual spouses. The Court stressed that this included listing both same-sex spouses on birth certificates, as recognition on the birth certificate carries important legal parenting rights.

Nonetheless, experts strongly recommend that same-sex married couples also obtain either a confirmatory adoption or parentage order. These orders are enforceable across state lines, and substantially reduce the risk that a non-birth parent's rights will be challenged.

Q: Do I need gender reassignment surgery to update my gender marker on my MI driver's license/state ID?

A: No. Michigan’s Secretary of State has changed the policy on requiring an amended birth certificate to update an individual’s gender marker on a state driver’s license or state ID. The new policy allows an individual to use the gender marker listed on an individual’s U.S. passport, U.S. passport card, or birth certificate. Many states, including Michigan, require surgery before changing a gender marker on a birth certificate. Because a U.S. passport can be obtained without surgery, or an amended birth certificate, surgery is no longer required to have an accurate state ID. This is helpful since not all individuals require surgery to complete transition.

In general, a passport is a substitute form of identification for a birth certificate. To change the gender marker listed on a passport, an applicant must provide medical certification stating the person is in the process of or has had appropriate clinical treatment for gender transition to the Passport Office.
