LICENSED CONTRACTOR vs. UNLICENSED CONTRACTOR 🪪🔨

In California, an unlicensed contractor can only perform work when the total cost of the project including labor, materials, and all other costs is LESS THAN $1,000.

That exemption only applies when:

✅ The project does not require a building permit
✅ No employee labor is used
✅ The total project cost stays below $1,000

You cannot break a larger project into several smaller contracts to stay under the limit.

Once the project reaches $1,000 or more or requires a permit or employees a valid California contractor’s license is required.

A licensed contractor can legally take on larger projects, advertise their license, pull permits within their classification, and build a legitimate business customers can verify.

Being talented in the trade is not enough. Your contractor’s license protects your reputation, expands your opportunities, and gives you the foundation to build a real company.

Subcontractor W-9/1099 OR EMPLOYEE? KNOW THE DIFFERENCE. 🚨

Calling someone a “subcontractor,” having them fill out a W-9, or issuing them a 1099 does not automatically make them an independent contractor.

In California construction, if someone is performing work that requires a contractor’s license, they must hold a valid license to qualify as an independent contractor. But the license alone is not enough, the actual working relationship matters.

A legitimate subcontractor generally:

✅ Holds the proper contractor’s license
✅ Operates an independent business
✅ Controls their own schedule and how the work gets completed
✅ Provides their own tools and equipment
✅ Purchases or supplies their own materials when required by the agreement
✅ Works under a defined subcontract and price
✅ Has the ability to work for other contractors or customers
✅ Is responsible for their own business expenses, insurance, and taxes

If you decide when they arrive, when they leave, when they take lunch, how they perform every task, and you provide the tools while supervising them like part of your regular crew you may be treating that person as an employee, regardless of what the paperwork says.

Misclassification can expose a contractor to back wages, overtime, payroll taxes, workers’ compensation claims, penalties, and additional liability.

Don’t use a 1099 to avoid the responsibilities that come with having employees. Build your company correctly, protect your workers, and protect your contractor’s license.

This is California law, not just an opinion. Always confirm your specific situation with a qualified labor attorney, CPA, or employment professional.
