The Florida Department of Financial Services, Division of Insurance Agent and Agency Services has recently called into question the ability of a non-licensed adjuster to serve as an appraiser in a property loss.

To clarify the Division’s position and to comply with all applicable laws and regulations, the Windstorm Insurance Network, along with the IAUA and PLAN, filed a Petition for Declaratory Statement to seek an opinion as to the applicability of various statutes.

Just Added at WIND 2023: Special Session Addressing the Passage of SB 2-A (Property Insurance)

Wednesday, January 25, 2023 | 5:15 PM – 6:15 PM

Florida's Senate Bill 2A, Property Insurance, was passed in December 2022, and has a far-reaching impact on our industry. The bill is intended to ensure policyholders have access to quality, affordable private market property insurance, and requires insurers to more promptly communicate, investigate, and pay valid claims. The bill addresses anticipated shortages in the reinsurance market and eliminates one-way attorney fees for property insurance. The bill strengthens the regulatory authority of the Office of Insurance Regulation over property insurers.

Illon Kantro, an insurer attorney at Berk, Merchant & Sims, PLC, and Chip Merlin, a policyholder attorney at Merlin Law Group, P.A. Group will address the key points of the legislation and the possible affects on those in the windstorm insurance industry.

Our first full day of conference began with keynote remarks by Admiral Thad Allen, U.S. Coast Guard (Ret.). Admiral Allen shared his experiences as the lead federal official for the responses to Hurricanes Katrina and Rita and the National Incident Commander for the Deepwater Horizon oil spill. He discussed his focus on "Unity of Effort," and the challenges of coordinating responses across numerous government entities and nonprofit organizations.

In our first general session panel, speakers from Swiss Re, Claim Resolved, The Deft Group, and Cassel & Cassel, P.A. participated in a well-received discussion and demonstration of using advanced technology in the claims handling arena.

The afternoon included Umpire Certification and Re-Certification workshops, along with a variety of workshops, such as Comprehending Condominium Claims, Navigating Strange and Unusual Claims with Professionalism, and a Recent Case Law Review.
