❗️UK restricts student dependents and student-work visa switches

International students on master’s programs in the UK will no longer be able to bring dependents to the UK from next year, under new rules from the Home Office, which has also said that students will no longer be able to switch to work routes until their studies have been completed and that it will clamp down on “unscrupulous agents”.
The changes have been announced today (May 23rd) in a written statement by the Home Secretary Suella Braverman.

Under current rules, all international postgraduate students are allowed to bring family members to the UK. But under the new regulations from January 2024, that will be restricted to students on “postgraduate courses currently designated as research programmes”.

The Home Secretary also said that there would be “steps to clamp down on unscrupulous education agents who may be supporting inappropriate applications to sell immigration, not education”.

The UK government has announced the changes after months of speculation.
Other changes in the package include a review of maintenance requirements for international students and dependents; more targeted enforcement activity; and better communication of immigration rules to the sector and to students.

The Home Secretary said, “We are committed to attracting the brightest and the best to the UK. Therefore, our intention is to work with universities over the course of the next year to design an alternative approach that ensures that the best and the brightest students can bring dependants to our world-leading universities while continuing to reduce net migration. We will bring in this system as soon as possible, after thorough consultation with the sector and key stakeholders.”

Some restrictions on the student visa route have been anticipated for several months since the Home Secretary made a speech at the Conservative Party conference in October last year. Local media outlets have reported on splits within the government over whether students should be restricted.

The announcement of restrictions on dependents comes ahead of the publication of net migration figures later this week, which is expected to be at a record level of around 700,000.

Last year, 135,788 visas were granted to the dependents of international students, an increase of more than 700 percent compared with 2019, which the Home Secretary described as “an unexpected rise”.

Post-study work rights for international students, which were restored through the Graduate Route in July 2021, will remain under the new system. The Graduate Route has been credited as a major factor in the increase in international students in recent years.

The Home Secretary said that the government was still committed to meeting its International Education Strategy commitments. The strategy was first announced in 2019, and the target of hosting 600,000 international students by 2030 was surpassed a decade early. In 2021/22, there were 679,970 international students at higher education institutions in the UK, according to the Higher Education Statistics Agency (HESA).

In response to the Home Office update, Jamie Arrowsmith, Director of Universities UK International (UUKi), welcomed some clarity after months of speculation and the fact that the Graduate Route will remain open.

He said in a statement that the association recognized that in some places, the rise in student dependents had exceeded expectations and led to local challenges with accommodation and schooling, but called for further clarity and support.

“While the vast majority of students will be unaffected by proposals that limit the ability to be accompanied by dependents, more information is needed on the programs that are in scope before a proper assessment of the impact can be made. Yet we do know that any changes are likely to have a disproportionate impact on women and students from certain countries. We, therefore, urge the government to work with the sector to limit and monitor the impact on particular groups of students – and on universities, which are already under serious financial pressures. The review process that has been announced must consider these issues.”

Jamie added, “Ultimately, our collective aim must be to ensure that international students who choose the UK can be confident that they are welcome here, that their contribution is valued, and that the terms on which they have made decisions remain stable. Anything that threatens to affect the UK’s global success as a top destination for international talent needs to be considered very carefully."
