Every country has a specific rules and term to buy or rent a house which is very important for any foreigner want to rent a place in a country like Turkey. Foreign people, who have received the residence permit in Turkey, can rent a home in Turkey. When a lease is made for foreigners in order to avoid legal problems in the future, contracting is important in the context of the law. The lease is a formal, written form that allows the landlord to rent the home to the tenant, and the tenant gets the right to use the property in return for the rent. The lease between the landlord and the tenant acts as a security measure against potential irregularities.

Items must Mentioned in Lease

• House plate
• The neighborhood where the house is located
• The street and alley where the house is located
• Material of rented property
• First name and last name of the property owner
• National identity number of the property owner
• landlord’s address
• First name and last name of the tenant
• National identity number of the tenant
If foreign nationals send the following documents from mentioned organizations to the Administration of Population and Citizenship affairs electronically, they may obtain a special national identity number for foreign nationals:
• The address of the tenant
• Lease Start Date
• Duration of the contract
• Monthly rental expense
• Yearly rental expense
• How to pay the rent
• Purpose of using the property
• Property Condition
• Accessories rented with the property

General Conditions of Lease

The lease must contain the following to protect the rights of both parties when renting a home in Turkey is meant:
• The tenant should use the leased property carefully.
• The tenant should treat the neighbors near the rental property well.
• The tenant cannot lease or transfer the leased property to a third party.
• The tenant cannot make any changes to the property except with the written permission of the landlord. For home repairs, renovations and the like, it is necessary to obtain the permission of the landlord.
• If the lease terminates or the tenant does not renew the contract, the tenant is obliged to return the property to the landlord the same day it was delivered. If there are any damages or defects in the Accessories within the house, the tenant is liable to pay damages to the landlord.
• Upon termination of the contract, if the house is to be sold or rented, the tenant is required to allow a house survey.
• If the tenant spends on items such as packages, radiators, satellites, metal doors, and parquet, he must obtain written permission from the homeowner beforehand.
• In the situation that the rental home has to be evicted, the tenant will be liable for any financial losses incurred if he/she fails to evacuate the home within the designated period.
• If there is pre-requisite money in the lease, the tenant must get informed on the reason. Also, the tenant needs to be careful about remaining the current condition of house appliances. The main rule in getting prerequisite money back is the difference in condition of house appliances in time of receiving and delivering them.

How to Increase Rent

If the condition for payment of foreign national’s rent is in foreign currency, they will have the right to appeal to the court if the exchange rate against the Turkish Lira rises. If in the lease it is agreed to pay for the rent in foreign currency, the rent increase is not allowed for 5 years, but after 5 years, the increase can be made.
If the lease payment agreement is in terms of Turkish Lira, 1 year after contract, the increase can be made. That is, if the contract is closed on 1 March 2018, the rent increase can be done on 1 March 2019. In such a situation, the rent increase is based on the “average annual rate of Producer Price Index” according to the monthly report of the Turkish Statistical Institute every month; therefore, it is not possible to increase this amount further.
For example, if the monthly rent is set at 1000 Turkish Lira, and at the end of one year the average producer price index is 7.8%, the new rent can eventually be determined at 1078 Turkish Lira. This is how renting a home in Turkey happen and everyone obey the rules of it.
