While, according to CAS case law (CAS 2008/A/1569), it is not in itself sufficient that an athlete is prevented from competing in sports events to justify a stay in itself, CAS has consistently recognized that, given the finite and brief career of most athletes, a suspension (subsequently found to be unjustified) can cause irreparable harm (see Preliminary Decision in CAS 2008/A/1453, para. 7.1), especially when it bars the athlete from participating in a major sports event.

Indeed, as long as they both are independent from the Athlete – which was not contested by the Appellant – the DCO and the chaperone have no specific interest in the outcome of the sample collection and there is no conflict of interest nor any risk of conflict of interest established arising solely from the fact that they are married.

The affected club argued that the German FA (DFB) would infringe the legal principle ‘nulla poena sine culpa’ (one cannot be punished for something they are not guilty of) by imposing sanctions on clubs only based on the behaviour of their alleged fans, although the club did not act with any kind of fault or negligence. Therefore, the club submitted that the imposed sanction violated the German ordre public. The German Federal Tribunal, however, considered that sanctions issued by sports federations for supporter misbehaviour are not ‘sanctions’ in a criminal law sense, but rather have a preventive and deterring character with the intention to further encourage clubs to invest in additional security measures in the future.

133. With regard to the sanction imposed on the Player in the Appealed Decision, i.e. the restriction of four months on his eligibility to play in official matches, the Appellants submitted in their written submissions that such a sanction abuses the Player’s human rights since it deprives him from his right to work, and it was further submitted that the imposed sanction causes him loss of market value and makes him unable to receive any bonuses from his current club.
134. For the sake of clarity, the Panel notes that a player who, during such a restriction period, is able to train with the team, does not suffer irreparable harm and is not having his human rights violated. The Appellants did not demonstrate otherwise.

Госдума на пленарном заседании приняла в первом чтении законопроект о введени Fan ID для болельщиков.

Законопроект закрепляет за правительством РФ определение спортивных мероприятий, которые можно будет посещать только при обязательной идентификации зрителей.

Вводится понятие «персонифицированная карта на посещение спортивного соревнования» – это электронный документ, необходимый для идентификации зрителя или участника турнира, осуществляемой «в целях обеспечения безопасности».

Ранее сообщалось, что на внедрение данной системы в 2021-2022 годах из бюджета будет выделено порядка 773 млн рублей.

Во вторник, 16 ноября, Госдума на пленарном заседании приняла в первом чтении законопроект о введении Fan ID для болельщиков.
