Hope you all are doing great. We know most of the 500 and 485 visa holders are in situation of distress and agony due to today’s migration policy changes.
Please do not be dejected.The date in effect will be announced soon.
Please read the following carefully,
🔴Not every announced measure necessarily takes effect immediately. Implementation may require
changes to the Migration Regulations, visa conditions, legislative instruments or application processes and specific commencement dates and transitional arrangements have not yet been confirmed in all
cases. The government needs time to draft the formal legislative regulations, change specific visa conditions and update administrative systems. This means we are currently in an interim "waiting window" before the new rules go live.
🔴Legal reforms like today usually go in effect on the same day. Some administrative tweaks can happen quickly via Ministerial Directions, while strict changes to visa subclasses require regulatory amendments that usually give the public a few weeks or months of notice. So the changes are currently not in effect.
🔴The date of effect has not yet announced. The current rules are still actively operating right now. If you lodge your partner's 485 or 500 subsequent entrant application during this window before the official legal start dates are locked in, your application will be legally processed under the old framework. Treat this as a time critical window to submit the application.
🔴 The family restriction rules targeting future graduate visa streams have a strict carve out for high level academia. PhD and HDR students will still be legally allowed to bring their partners and children to Australia as dependents. They are exempted from any restrictions.
If you already hold your 500 visa or 485 visa and your family is onshore, you are protected. If you have applied for subsequent entrant recently, you are protected. You can still apply to bring your family onto your visa as subsequent entrants while the current rules remain active.
