Sui Juris is a Latin terminology

Sui refers to ...one another
And juris means .......legal rights ...

Sui juris primarily means
"Having full legal rights to decide on thier own "
In simple words .

When a person need no guardian .....he is or she is
Sui juris

Normally this terms is used for Couple marrying each other.....

So they take the the pleas of being "sui juris"

According to section 21A, West Pakistan Family Court Act, minors can take stay on property of father.

The ability of minor children to take an interest in their father's property typically depends on the laws and regulations in the specific jurisdiction where the property is located. In many places, minors do not have the legal capacity to enter into property transactions on their own. Instead, a legal guardian or trustee may need to act on their behalf.

If there are concerns that a father may not sell a property in the best interests of the minor children, legal options may include seeking a court order or appointing a guardian ad litem to represent the children's interests in the matter.

No one other than the owner has rights over private property.
WAPDA cannot lay or install electricity supply over anyone's private property without permission according to ruling number 2018 CLC 1120

Gift/tamleek mutation
Gift by sister to her brother in her life time that is not challenged by her children cannot be challenged after her death.
Immoveable property gifted by a sister to her brother (Respondents/donees) had substantiated the fact of tamleek through cogent evidence in the form of the revenue record and witnesses produced before the Trial Court
Furthermore the suit of appellants was badly barred by time as the mutation in dispute was executed on 29.12.1981, whereas the suit was filed with a delay of almost 15 years on 3.5.1997
Appeliant had no locus standi to challenge the legality of the (gift) mutation on a vague allegation of fraud when the donor had never challenged the same in her life time and the mutation had been given effect in the revenue record
Suit for declaration and permanent injunction filed by appellants was rightly dismissed and the Appeal was dismissed as well

انکم ٹیکس آرڈینیس کے سیکشن 7E یہ سیکشن فرضی آمدنی ( Deemed Income) کے بابت ہے۔

پس منظر:

انکم ٹیکس آرڈینیس 2001 کے سیکشن 7E میں بنیادی طور پر 'مفروضہ قانونی'(Legal fiction) کا استعمال کر کے یہ قرار دیا گیا ہے کہ پاکستان کا 'رہائشی شخص' (Resident person)، اگر پاکستان میں موجود کسی ایسی 'غیر منقولہ جائیداد/اثاثہ' (asset/immovable property) جیسے کوئی پلاٹ/گھر وغیرہ کا مالک ہے جس کی نہ صرف قیمت ڈھائی کروڑ سے زائد ہو بلکہ وہ زراعت اور کاروبار کیلئے استعمال میں بھی نہ ہو، اور نہ ہی وہ اسکی واحد جائیداد ہوتو ایسی صورتحال میں یہ 'فرض' (deemed) کیا جائے گا کہ اس رہائشی شخص نےاس جائیداد/اثاثے کی 'اصل مارکیٹ قمیت' (fair market value) کے پانچ فیصد کے برابرسالانہ 'انکم/نفع' (income) کمایا ہے اور اس پانچ فیصد فرضی آمدنی پر وفاق حکومت بیس فیصد انکم ٹیکس وصول کرے گا۔ چاہے اس پلاٹ یا گھر سے آپ کچھ نہ کما رہے ہوں اور وہ خالی پڑا ہو۔ اسکے علاوہ جائیداد کی مارکیٹ قیمت بڑھنے پر ہر سال اس ٹیکس کی رقم بھی بڑھتی جائے گی۔ 'اصل مارکیٹ قیمت' (FMV/Fair Market Value) اوپن مارکیٹ میں کسی اثاثے متوقع قیمت فروخت کو کہتے ہیں

ISLAM GUARANTEES TO WOMEN ALL RIGHTS AS GUARANTEED IN THE ARTICLE 25 OF THE CONSTITUTION OF ISLAMIC REPUBLIC OF PAKISTAN.
