Maintenance of minor---Death of father during suit proceedings---Paternal uncle made liable for maintenance after death of father---Alleged transfer by paternal grandfather of part of his property to paternal uncle during pendency of maintenance proceedings---Disputed transaction requiring additional evidence---Facts: The petitioner was the paternal uncle of the minors and challenged concurrent judgments whereby he was directed to pay maintenance to one minor after the father's death---He contended that under Muhammadan Law no statutory liability to maintain a nephew rested upon a paternal uncle---Issue: Question for determination was “whether a paternal uncle could be held liable to pay maintenance to his deceased brother's minor child, particularly where property of the paternal grandfather was alleged to have been transferred to him during the pendency of the maintenance proceedings?”---Held: The respondents alleged that the grandfather had not abandoned the minors and that part of his property had been transferred to the petitioner during pendency of the suit---Determination of the bona fide nature and effect of the alleged transaction required recording of additional evidence and resolution of disputed questions of fact---Such factual determination could not be undertaken by the High Court in exercise of judicial review jurisdiction---Matter was remanded to the Appellate Court for decision afresh---Impugned order was set aside and constitutional petition was allowed, in circumstances.
