Criminal Procedure Code 👇

Detailed Steps of With Relevent Provisions.

A Criminal trial goes through the following steps.

1) FIR U/S 154 ,or Direct complaint U/S 200 of Cr.P.C 1898.

2) Investigation U/S 156 or inquiry Under section 202 of Cr.P.C 1898.

3) Record of statement and confession Under section 161 and 164 read with section 364 of Cr.P.C 1898.

(4)Physical Or police remand U/S 167, 344 of Cr.P.C 1898.

5) Submission of Challan Under section 173 of Cr.P.C 1898, under following modes;

A) Section 169 of Cr.P.C 1898.

Release of accused when evidence deficient.

⚖️ Procedure of Sessions Trial (Chapter XXII-A Cr.P.C.)
Under the Code of Criminal Procedure (Cr.P.C.), 1898, a trial before a Court of Session or a High Court is conducted for serious offences. This procedure is primarily governed by Chapter XXII-A (Sections 265-A to 265-N).

I. COMMENCEMENT OF THE TRIAL:
1. Conduct by Public Prosecutor (Section 265-A): In every trial before a Court of Session, the prosecution must be conducted by a Public Prosecutor.

2. Supply of Documents (Section 265-C): In cases initiated upon a police report, copies of the F.I.R., Police Report (Challan), and statements of all witnesses (under Sections 161 and 164) must be supplied to the accused free of cost at least seven days before the trial begins.

3. Framing of Charge (Section 265-D): If, after perusing the record and hearing the parties, the Court is of the opinion that there is ground for believing the accused has committed an offence, it shall frame a formal charge in writing.

4. Plea of the Accused (Section 265-E):

The charge is read over and explained to the accused.

If the accused pleads guilty, the Court may, at its discretion, convict him immediately.

If the accused claims trial (refuses to plead guilty), the Court proceeds to record evidence.

II. THE EVIDENCE STAGE:
1. Prosecution Evidence (Section 265-F): The Court takes all evidence produced by the prosecution. This includes examining witnesses and admitting relevant documents or material objects.

2. Examination of the Accused (Section 342): After the prosecution evidence is closed, the Court examines the accused to allow him to explain any incriminating circumstances appearing against him in the evidence.

3. Defence Evidence (Section 265-F): The accused is then called upon to enter his defence and produce his evidence (if any). The accused may also offer himself as a witness on oath under Section 340(2).

III. TERMINATION OF THE TRIAL:
1. Summing Up (Section 265-G):

If the accused produces no evidence, the prosecutor sums up the case, and the accused replies.

If the accused produces evidence, the accused sums up first, and the prosecutor replies.

2. Final Judgment (Section 265-H):

Acquittal: If the Court finds the accused not guilty, it records an order of acquittal.

Conviction: If the Court finds the accused guilty, it passes a sentence according to the law.

3. Special Power: Acquittal at any Stage (Section 265-K): The Court has the power to acquit an accused at any stage of the trial if, after hearing the parties, it considers that there is no probability of the accused being convicted.
