Press Release – Supreme Court Judgment Restores Rights of B.Tech & DAE Officers
PRESS RELEASE
Karachi / Islamabad –
The Sindh Graduate Engineering Technologists Forum has welcomed the landmark Judgment dated 17 February 2026 passed by the Hon’ble Supreme Court of Pakistan in Civil Appeal No. 84-K of 2023.
The apex Court has categorically set aside the Sindh Service Tribunal’s decision and clarified that the PEC Act, 1975 does not control government service structure or promotion policies. The misinterpretation of the so-called “Cautionary Note” from the Maula Bux case, which was used to deprive B.Tech and DAE officers of their lawful cadre positions, now stands judicially corrected.
For years, senior officers in BS-17 to BS-20 were denied promotions and postings, while junior officers were elevated through an incorrect legal interpretation. This injustice must now end.
The Forum demands:
• Immediate restoration of original cadre positions;
• Cancellation of unlawful promotions granted through misinterpretation;
• Transparent and merit-based review of all promotions;
• Equal treatment under Article 25 of the Constitution.
Chairman Engineer Sabeeh Ahmed Shaikh stated:
“The Supreme Court has spoken clearly. No department can now hide behind a misreading of law. Implementation is not optional — it is mandatory.”
The Forum warns that any delay in implementing the Supreme Court’s Judgment will compel affected officers to seek legal recourse including contempt proceedings.
