🚨 USA Immigration Update – New Public Charge Policy Challenged in Federal Court!

On September 14, 2026, a coalition of 22 states and Washington, D.C. filed a lawsuit challenging the U.S. government’s revised Public Charge Rule. Separately, New York City Mayor Zohran Mamdani led a coalition of cities and counties in another legal challenge against the policy.

The new rule is scheduled to take effect on September 18, 2026, and would give immigration officers broader discretion to consider certain public benefits when evaluating some visa and Green Card applications. The lawsuits argue that the policy is unclear and exceeds federal authority, while government officials defend the rule’s purpose.

Breaking News:
NVC Sends New 28-Question Questionnaire to Immigrant Visa Applicants | EB-2 NIW & Other Applicants
The National Visa Center (NVC) has started sending a detailed questionnaire to certain immigrant visa applicants requesting additional information before further consideration of their immigrant visa applications.
In this video, we explain the 28-question questionnaire and its five major sections:
πŸ”Ή Section 1 – Work: Employment prospects, working years, Social Security/Medicare, pensions and retirement resources.
πŸ”Ή Section 2 – Health: Medical conditions, treatment plans, health insurance and potential treatment costs in the United States.
πŸ”Ή Section 3 – Family Status: Dependents, special medical needs and plans for long-term care and support.
πŸ”Ή Section 4 – Assets, Resources & Financial Status: Property, bank accounts, liquid and illiquid assets, debts, emergency funds and proof of financial resources.
πŸ”Ή Section 5 – Public Cash Assistance & Long-Term Institutionalization: Past public benefits, welfare or charitable assistance, changed circumstances, joint sponsors and the likelihood of future financial support.
πŸ“Œ What does this mean for immigrant visa applicants?
Receiving this questionnaire indicates that additional information is being requested for consideration of the applicant's case. However, receiving the questionnaire does not itself mean visa approval, interview scheduling, or guaranteed visa issuance.
Applicants should carefully answer each question truthfully and completely and provide supporting documentation through CEAC, following the specific instructions provided by NVC or the relevant U.S. Embassy/Consulate.
This development is particularly important for EB-2 NIW and other employment-based immigrant visa applicants who are undergoing consular processing.
Watch the full video to understand the questionnaire, the five sections, the type of evidence that may be relevant, and important considerations when preparing your response.
