2024 MLD 907
In 2024 MLD 907, the Honorable Supreme Court has upheld the concurrent judgments granted by the courts below. In the instant matter, the police has booked three person for committing Robbery or dacoity with common intention. The prosecution has successfully made its case with beyond reasonable doubt.
Facts of the Case:
The complainant with his son along with the worker in the shop, were in the shop. Out of no where, three bike riders with a CD motorbike came to the shop with a gun. And one of them took out 250000 from the drawer. While returning, the complainant's son tried to grab him, but the boy with a gun opened fire on him. He with one of the workers injured due to gun shot.
The complainant went to the P.S. which was nearby. The matter was reported after 25 minutes of the occurance because the police station was one and half furlong away from the occurance. Therefore, the FIR was registered in promptu.

1. Sections 397 & 34 of Pakistan Penal code.
Reasons of concurrent judgement:
1. The FiR was just made in time without any inordinate delay
2. Ocular evidence was present on the spot
3. Recovery of pistol made from the accused
4. The injuries sustained by the witnesses was supposed by the medical evidence given by the doctor who issued MLC.
