Understanding Legal Proceedings: Examination-in-Chief, Cross-Examination, and Re-Examination

In legal proceedings, the questioning of witnesses plays a crucial role. Let’s delve into the three stages: examination-in-chief, cross-examination, and re-examination.

Examination-in-Chief:
During this stage, the party calling a witness (or their counsel) seeks to elicit evidence that supports their version of the facts in issue.
The witness provides their account of events without leading questions.
Exceptions include young and vulnerable witnesses, refreshing memory, and certain statements.
The goal is to establish the case for the party calling the witness1.
Cross-Examination:
Immediately after examination-in-chief, the opposing party’s legal representative questions the witness.
The purpose is to challenge the witness’s testimony, reveal inconsistencies, and explore alternative versions of events.
Leading questions are allowed, allowing the advocate to supply facts instead of the witness.
Cross-examination aims to weaken the opposing case23.
Re-Examination:
After cross-examination, the party calling the witness has the opportunity to clarify any points raised.
Re-examination is limited to matters arising from cross-examination.
It reinforces the witness’s credibility and clarifies any doubts left by the opposing party’s questions1.

Do you know what a plea of alibi is and how it can save you from a false accusation?

A plea of alibi is a legal defence that you can use if you are accused of a crime that you did not commit. It means that you have proof that you were somewhere else when the crime happened, and you have evidence to back it up. For example, if you are charged with murder, but you have a CCTV footage of yourself at a mall at the time of the killing, you have a plea of alibi.

A plea of alibi can be a lifesaver for innocent people who are wrongly accused of serious crimes. However, it is not as easy as it sounds. There are some rules and challenges that you need to know before you use this defence:

- You have to raise the plea of alibi as soon as possible in the legal process. If you delay or hide your alibi, the court may not believe you or may think that you are lying.
- You have to provide strong and reliable evidence to support your plea of alibi. This can include witnesses, documents, phone records, GPS data, etc. The evidence must show that it was impossible or highly unlikely for you to be at the crime scene.
- You have to face the burden of proof for your plea of alibi. This means that you have to convince the court that your evidence is true and sufficient. The prosecution does not have to disprove your plea of alibi, unless they have positive evidence to show that you were at the crime scene.
- You have to be careful not to contradict yourself or your evidence. If you make any false or inconsistent statements, the court may reject your plea of alibi and consider it as a confession of guilt.
