Pakistan is four days away from a general election, and the mood in the country is not one of high energy, fervent canvassing, and electrifying electoral activity, but it’s the mood of a funeral you would rather not be at.

So many factors explain this:

1- The electorate is convinced this is not going to be a fair competition, and the outcome is already determined.

2- They’re absolutely helpless in affecting any democratic change through ballot as long as the process is not managed from without.

3- The only mobilized voters are of PTI that have any enthusiasm at all for this process, but they’ve been violently silenced through murders and courts

4- Those who are “favored” do not feel the need to expend their temporal and monetary resources to win because their victory is confirmed.

In such a state, Pakistan’s democracy will receive a hit from this with consequences spanning over many years, possibly decades. The chokehold of the establishment must be broken for any hope of democratic development in the country.

Summary of the Proposed Constitutional Package about the Provisional Provincial Status to be given to Gilgit Baltistan:

1. No amendment in Article 1 of the Constitution of Pakistan is suggested by the Federal Law Minister in concurrence with NSA and FO which was eventually agreed by CM GB and the minister of KA&GB.

2. A new Article 258A is suggested to be inserted in the constitution which will grant the Provisional Provincial Status to GB without altering or derogating the declared stance of the Government of Pakistan regarding the Kashmir Dispute.

3. GB is suggested to have 4 seats in National Assembly (3 General and 1 Woman) by amending Article 51.

4. GB is suggested to have 4 seats in Senate (2 General, 1 Woman and 1 Technocrat) by amending Article 59 of the constitution, subject to the approval from the PM who will have the final say regarding Senate representation of GB.

5. The seats of the GB Provincial Assembly will remain the same i.e. 33 (24 General, 6 Women, 3 Technocrat).

6. GB Chief Court will be renamed to GB High Court as in other provinces of the country.

7. Chief Appellate Court will be abolished.

8. GB Election Commission will be disbanded and GB Election Commissioner will be appointed as a member of the Election Commission of Pakistan till the end of his current tenure.

9. The package will be presented to GB Assembly for approval after its finalization from PMO.

10. The said package will then be presented in National Assembly as a Constitutional Amendment (26th) and will require a 2/3rd majority.

جی بی اسمبلی سے عال چاکنگ پر پابندی کے قانون پاس ہونے کے باوجود نامعلوم افراد گلگت بلتستان کے حسن کو خراب کرنے پر تلے ہوئے ہیں اگر ایسے افراد اپ کو ملے تو قانون اپ کو اختیار دیتا ہے کہ اس کو پکڑ کر قانون کے حوالہ کرے اس کی سزا 3 سال قید اور ایک لاکھ جرمانہ ہے.

Power of Pakistani Prime Minister (unelected by the people of GB) over the people of GB according to the Bill proposed by PMLN Government:



60. Legislative Powers.- (1) Subject to this Order, both the Prime Minister
and the Assembly shall have the power to make laws,-
(a) for the territories of Gilgit-Baltistan;
(b) for all citizens of Gilgit-Baltistan; and
(c) for the employees of the Government, wherever they may be.
(2) Subject to this Order -
(a) the Prime Minister shall have exclusive power to make laws with
respect to any matter in the Legislative List set out in the Third
Schedule, hereinafter referred to as the Legislative List:
Provided that, any law with respect to matters in Part-II of
the Legislative List shall be made after consultation with the
Governor and the Chief Minister:
Provided further that, the Chief Minister may present such
law before the Assembly for discussion.
(b) the Prime Minister and the Assembly shall have power to make laws
with respect to criminal law, criminal procedure and evidence;
(c) subjectto clause (b) and sub-section (6), the Assembly shall and the
Prime Minister shall not, have power to make laws with respect to
any matter not enumerated in the Legislative List;
(3) The Prime Minister shall have the powers to adopt any amendment in the
existing laws or any new law in force in Pakistan subject to the legislative competence
under sub-section (2).
(4) If any provision of an Act of Assembly is repugnant to any provision of any
law which the Prime Minister is competent to enact, then the law made by the Prime
Minister, whether passed before or after the Act of the Assembly, shall prevail and the
Act of the Assembly shall,to the extent of the repugnancy, be void.
(5) If the Assembly passes a resolution to the effect that the Prime Minister
may by law regulate any matter not enumerated in the Legislative List, it shall be lawful
for the Prime Minister to make law for regulating that matter accordingly, but any law so
made may be amended or repealed by Act of the Assembly.
(6) Notwithstanding anything contained in this Order the Prime Minister and
the Assembly shall have no power to make any law concerning,-
(a) the defence and external security of Gilgit-Baltistan;
(b) the current coin of the issue of any bills, notes or other paper currency; or
(c) the external affairs of Gilgit-Baltistan including foreign trade and foreign
aid; or
(d) such other matters as the President may specify by Order.
(7) Notwithstanding anything contained in this Order, the Government may
with the consent of the Federation entrust either conditionally or unconditionally, to the
Federation, functions in relation to any matter to which the executive authority of the
Government extends:
