📌 لاہور ہائی کورٹ نے فیصلہ دیا کہ جب شریک مالکان (Co-sharers) کسی دستبرداری/تملیک نامہ (Relinquishment Deed) کو جعلی اور فراڈ پر مبنی قرار دیں تو اس دستاویز سے فائدہ اٹھانے والے (Beneficiary) پر لازم ہے کہ وہ اس کی قانونی حیثیت، صحیح اجرا اور گواہوں کے ذریعے اس کا ثبوت فراہم کرے، بصورت دیگر ایسی دستاویز اور اس کی بنیاد پر ہونے والی انتقالات (Mutations) غیر مؤثر تصور ہوں گے۔

❓ بنیادی قانونی سوال (Question of Law)
کیا مبینہ تملیک نامہ اور اس کی بنیاد پر ہونے والے انتقالات قانونی طور پر درست تھے یا فراڈ پر مبنی ہونے کی وجہ سے کالعدم تھے؟
⚖️ عدالت کا فیصلہ (Held)
✅ تملیک نامہ ثابت نہیں ہوا۔
عدالت نے قرار دیا کہ:
✔ مدعیان نے ابتدا ہی سے فراڈ کا مؤقف اختیار کیا۔
✔ فائدہ اٹھانے والے مدعا علیہ پر لازم تھا کہ وہ تملیک نامہ کی قانونی حیثیت ثابت کرتا۔
✔ تملیک نامہ صرف ایک گواہ سے تصدیق شدہ تھا جبکہ قانون دو گواہوں کا تقاضا کرتا ہے۔
✔ ضروری سرکاری گواہ پیش نہیں کیے گئے۔
✔ تملیک نامہ اور اس پر مبنی انتقالات قانونی طور پر ثابت نہ ہو سکے۔
✔ دونوں عدالتوں کے فیصلے کالعدم قرار دے کر دوسری اپیل منظور کر لی گئی۔
📖 عدالت کی تفصیلی وجوہات
⚖️ 1۔ فائدہ اٹھانے والے پر ثبوت کا بوجھ تھا
مدعیان نے واضح طور پر انکار کیا کہ انہوں نے کوئی تملیک نامہ کیا ہے، لہٰذا اس دستاویز سے فائدہ اٹھانے والے مدعا علیہ پر اس کی صحت ثابت کرنا لازم تھا۔
⚖️ 2۔ دو گواہوں کی قانونی شرط پوری نہ ہوئی
تملیک نامہ صرف ایک گواہ سے تصدیق شدہ تھا جبکہ Articles 17 اور 79 کے مطابق دو گواہوں کی تصدیق ضروری تھی۔
⚖️ 3۔ گواہوں نے دستاویز کی تصدیق نہیں کی
پیش کیے گئے گواہ اپنے دستخط یا انگوٹھے کی درست شناخت بھی ثابت نہ کر سکے۔
⚖️ 4۔ سرکاری گواہ پیش نہ کیے گئے
Lambardar، اہلِ کمیشن اور Sub-Registrar کو بطور گواہ پیش نہ کرنے پر عدالت نے منفی قانونی مفروضہ (Adverse Inference) اخذ کیا۔
⚖️ 5۔ انتقالات بھی غیر مؤثر قرار پائے
جب اصل تملیک نامہ ہی ثابت نہ ہوا تو اس کی بنیاد پر ہونے والے انتقالات بھی غیر قانونی قرار پائے۔
⚖️ 6۔ نچلی عدالتوں نے شہادت کو غلط پڑھا
ہائی کورٹ نے قرار دیا کہ ٹرائل کورٹ اور اپیلیٹ کورٹ نے شہادت کا غلط جائزہ لیا، اس لیے ان کے فیصلے برقرار نہیں رہ سکتے۔

(a) Specific Relief Act (I of 1877)---
----S. 42---Qanun-e-Shahadat (10 of 1984), Arts. 17 & 79---Co-sharers' ownership claim---Fraudulent relinquishment deed, allegation of---Burden of proof---Onus upon beneficiary to prove transaction/document---Scope---Appellants filed a suit for declaration and injunction claiming ownership of the suit property as legal heirs and co-sharers, alleging that defendant No. 1 fraudulently prepared a fake relinquishment (tamleek) deed and transferred the land through mutation in favour of defendant No. 3---The suit dismissed twice by the Trial Court (including post-remand), and the first appeal was also dismissed, leading to the present second appeal before the High Court---Question needing determination was "whether the alleged relinquishment deed and subsequent mutations were fraudulent and without legal effect, thereby invalidating the defendants' claim to ownership?"---Held: Appellants/plaintiffs in their plaint categorically pleaded that they did not execute any relinquishment deed and the said transaction was based on fraud---Being beneficiary of the transaction, the burden shifted upon the respondents/defendants to prove the validity of the deed, initially by specifically describing the day, date, time, place, names of witnesses and venue of the transaction in the pleadings (written statement), and such stance should have been proved through cogent evidence---Moreover, the relinquishment deed showed that it was attested by a single witness, whereas, as per Arts. 17 & 79 of the it Qanun-e-Shahadat, 1984, mandatory that such document be attested by at least two witnesses---Therefore, proof of valid ex*****on of the relinquishment deed failed---Moreover, the witnesses did not exhibit their signatures/thumb impressions on the alleged relinquishment deed; hence, the respondents/defendants could not prove valid ex*****on of the said document---Further, failure of the respondents/defendants to produce official witnesses (Lambardar, Ahle-Commission and Sub-Registrar) raised an was adverse inference---Concurrent judgments and decrees of the courts below were set aside---Present second appeal was allowed, in circumstances.
