FLOATING STATUS SA AGENCY

Ang mga nagttrabaho sa agency ay REGULAR NA EMPLEYADO NG AGENCY. Ibig sabihin, kahit matanggal sila sa Principal, hindi ibig sabihin nito na tanggal ka na sa trabaho - naka floating status ka lang sa Agency mo.

HUWAG MAGRERESIGN KAPAG NATANGGAL SA PRINCIPAL. Ito ay dahil responsibilidad ng Agency na hanapan ka ng ibang trabaho o ibang Principal sa loob ng 3 BUWAN. Kapag hindi ka nabigyan ng trabaho, dapat ka bigyan ng SEPARATION PAY ng Agency mo.

Kapag hindii tumupad ang Agency sa batas, maaari itong kasuhan ng CONSTRUCTIVE ILLEGAL DISMISSAL sa National Labor Relations Commission. Wala po bayad ang mag file ng complaint sa NLRC at hindi pa kailangan ng abogado sa umpisa. Maaaring magpatulong mag file ng kaso sa mga Unyon o Pederasyon ng mga manggagawa, tulad ng Partido Manggagawa.

FREEDOM OF ASSOCIATION

Section 8, Article III, 1987 Constitution:

The right of the people, including those employed in the public and private sectors, to form unions, associations, or societies for purposes not contrary to law shall not be abridged.

Isang mabisang paraan upang maprotektahan ang mga karapatan ng mga manggagawa ang pagbuo o pagsali sa isang unyon. Kinikilala ng batas ang mga unyon bilang napakahalagang institusyon upang isulong ang interes ng mga manggagawa sa pamamagitan ng collective bargaining sa employer o kumpanya.

Hindi totoo na kapag may unyon ay puro strike lang at gulo. Wala itong pinagkaiba sa ibang samahan, grupo, club, asosasyon o organisasyon - nagkataon lang na kapag grupo ng manggagawa, ang teknikal na tawag ay UNYON. Kapag sama-sama at may grupo o unyon, mas makaka negotiate ang mga manggagawa para TUMAAS ANG SAHOD, MADAGDAGAN ANG BENEPISYO, AT MAIPAGLABAN ANG KARAPATAN.

Kung gusto magbuo o sumali sa isang unyon, magmensahe lamang sa page na ito o kaya ay sa Alliance of General Unions, Institutions and Labor Associations upang kayo ay ma assist. Wala po itong bayad.
