Beware of the word “CLEAN TITLE”.
You can only call it clean title IF:

✅ Owners that appear in the title of the property are still ALIVE & CAN SIGN documents

✅ NO disputes attached in the title AND “certified true copy” of the title.

Please take note of the “AND” because not all disputes are printed in the original title itself. Thus, it is very important to request for the latest certified true copy of the title.

✅ All real estate taxes are paid on time. Always request for latest real estate tax clearance.

✅ The owners are married (on or after 1987) The property is considered conjugal even if only one property owner is in the title. Both should sign sale documents. Should the property owner dies, heirs should file and pay for the estate tax of all the properties.

✅ The property estate taxes are not yet paid, the property cannot be called “CLEAN”.

✅ Magkaiba po ang real estate tax na binabayaran ninyo annually at ang estate tax (BIR FORM 1801) You only pay estate tax if the owner in the title ay deads na. Penalties (like big penalties) apply for late filing.

Public service lang po 🙂. Ang estate tax clearance po is NON-NEGOTIABLE. Kailangan talaga syang e file at bayaran whether you like it or not, pag nadeads ang owner na nakalagay sa title. Is it safe to buy a property with CLOA TITLE?

Looking for a property to invest or a land where you can build your future home one can be taxing. There are are lot of factors to look into including and importantly the legality of the property that you are eyeing.

Is someone selling you a property or have you gained interest in a property that has CLOA title and you’re not sure whether or not it is safe to buy a property with CLOA Title? Here are some of the important information about CLOA land to help you decide whether or not it is worth all the effort to acquire it.

What is CLOA Title?
Certificate of Land Ownership Awards or CLOA is a document that states ownership of the land granted or awarded to the beneficiary by the Department of Agrarian Reform (DAR). This means that the current owner of the CLOA land had acquired the property from DAR.

Can the owner sell the CLOA Land awarded to him?
The CLOA land is legally under the name of the owner or the beneficiary but it has some conditions and restrictions under the Comprehensive Agrarian Reform Law (CARL) and other applicable law. Included in the limitations is the selling or transferring of ownership of the CLOA Land to other people.

Unfortunately, CLOA lands cannot be alienated or sold to any other person. There is an existing 10-year restriction period from the time the land was award to the beneficiary stating that the beneficiary cannot dispose of these lands whether bu selling it or transferred.

Selling them to any developer or any private citizen without the permission of DAR considered illegal.

When can I buy a land with CLOA Title?
Since the CLOA land beneficiary is prohibited to sell, transfer or convey the right to use the land, it can only be sold, transferred or conveyed to their children, the government, the Land Bank of the Philippines (LandBank), or other qualified beneficiaries after 10 years.

Only after 10 years that the CLOA land title restrictions has lapsed can you safely and legally purchase the land.

Under the land reform law, farmer-beneficiaries can only sell the land after 10 years and/or only after the original owner has been compensated.

Should you invest in a CLOA titled land?
The straight answer to this is unless the CLAO titled is over 10 years old or the current owner or beneficiary had fully compensated the original owner of the land is when it is safe to buy the property. When buying a piece of property, one of the most crucial steps to complete the process is the transfer of land title from the previous owner to the buyer. This legal process is essential as it provides the buyer with a public record declaring him or her as the new owner of a particular property. By having a new land title that carries your name, you can protect your investment and avoid any ownership issues that may arise in the future.

IMPORTANT😊😊😊 it is advisable for a buyer to begin the process of transferring the title right after the Deed of Sale has been executed. “Once the Deed of Sale is executed and notarized, the deadline for the payment of the transfer taxes will be in effect. There will be corresponding penalties and interest charges for late payments of transfer taxes,”

TO START😊😊😊 you need to have the following requirements on hand:
• Original copy of the notarized Deed of Absolute Sale (DAS), plus two photocopies
• Owner’s duplicate copy of the Transfer Certificate of Title (TCT) or the Condominium Certificate of Title (CCT) in case of sale of condominium units, plus two photocopies
• Certified True Copies of the latest Tax Declaration for land and improvement of the real property plus two photocopies. If the property sold is a vacant lot or no improvements have been made on it, a Sworn Declaration of No Improvement by at least one of the transferees or Certificate of No Improvement issued by the City or Municipal Assessor
• Tax Identification Numbers (TIN) of the Seller and Buyer

Additional requirements (if applicable):
• Special Power of Attorney (SPA), if the person signing on the document is not the owner as appearing on the TCT or CCT
• Certification of the Philippine Consulate if the SPA is executed abroad
• Location plan or vicinity map if zonal value cannot readily be determined from the documents submitted
• Such other requirements as may be required by law, rulings, regulations, or other issuances

6 Steps Bago Bumili ng Lupa sa Pilipinas

Step 1
Unang-una basta't dumating yung ahente (real estate agent) o kaya yung may-ari ng lupa at sinabing pinagbibili niya ang LUPA niya, ang UNANG KUKUNIN MO ay yung kopya ng TITULO.

Sapagkat dapat mag-imbestiga ka doon sa REGISTER OF DEEDS. May xerox copy ka ng titulo ng lupa, pupunta ka doon, Kasi malay mo may mga PASANIN (problema) yang lupang yan: nakaprenda/nakasanlamay nagki-CLAIM na iba Dapat makita mo yon. Dapat malinis. Sapagkat yang kopyang yan dapat eksaktong-eksakto doon sa kopya ng Register of Deeds. Hindi sila nagkakaiba. Kaya malalaman mo kung PEKE, may mga PASANIN, o kaya may mga PROBLEMA ang lupa.

Step 2

Kumuha nang Geodetic Engr para mag Sagawa nang Relocation survey sa Mga Boundaries para ma check kong ok ba ang Actual ground wala bang structure or Fence sa Kabilang lot na lumagpas.. Sa Property na iyung Bibilhin.

Step 3

Halimbawa't nakita mo na, na wala palang problema, ok ang ganda, mag-eexecute kayo ng DEED of SALE na tinatawag. Pagka nag-eexecute kayo ng DEED of SALE o "Kontrata ng Pagtitinda", pipirmahan nyong dalawa, nung nagtitinda at tsaka nung bumibili at inonotarized yon.

Step 4
Within 1 month from notarization, magbabayad ng unang bayad. Ang tawag dun, DOCUMENTARY STAMPS. Dapat bago matapos ang buwan ng pagpipirma, magbabayad ka ng DOCUMENTARY STAMPS.

Step 5
Pagkatapos nun, yung nagtinda, sya rin ang magbabayad ng tinatawag na CAPITAL GAIN TAX. Kasi kumita siya, magbabayad siya sa BIR.

At ang BIR ang mag-iissue nung CERTIFICATE OF AUTHORITY TO REGISTER, isang certification na sinasabi sa Register of Deeds na bayad na yan ng lahat ng mga taxes at pwede mo ng ilipat ang pangalan ng titulo dyan doon sa bumili.

Step 6
Basta nakita mo na yan (CERTIFICATE OF AUTHORITY TO REGISTER), dadalhin mo yan sa Register of Deeds, yun ang huling yugto. Sasabihin ng Register of Deeds, heto ang huling bayad, Transfer Fees. Pag bayad na yon, hindi masyadong mahal yon, hayan na, kukunin na ng Register of Deeds lahat.

Isusurender na ang OWNERS' COPY ng titulo at maghihintay ka na. At yan kelangan mo ng follow-up. Dahil nga sa Register of Deeds, medyo tatagal yan. Kaya kelangan ng follow-up ng follow-up.

Ibig sabihin nito na ang tax declaration ay hindi siguradong ebidensiya ng pagmamay-ari ng lupa. While tax declarations and receipts are not conclusive evidence of ownership and do not prove title to the land.
