BCDA falsely claims it was unaware of property sales in Camp John Hay and only recognized 25-year leases. However, overwhelming evidence shows that BCDA itself required and approved the 50-year lease structure from the very beginning in 1996.

1. BCDA Explicitly Required and Publicly Announced the 50-Year Lease Multiple Times

Robinsons Land Corporation (Prudencio Castillo) : “Are we really looking only at 25-25. Beyond that is a different regulation. Originally, it was just 25 and then negotiate for another 25..”
BCDA (Rogelio Singson) : “On the same terms, that is why we are asking you for a 50-year plan.”

31 MAY 1996 – BCDA Vice Chairman Mr. Rogelio Singson’s Response to San Antonio Resources’ Mr. Roberto Cuenca during the Second Pre-Qualification Conference for the Privatization of Club John Hay

SAN ANTONIO RESOURCES (Bobby Cuenca) : “I just wanted to clarify something. I seem to have missed something here. My understanding was that this was going to be a 25-year lease renewable for another 25?”

BCDA (Rogelio Singson) : “Yes. Practically. It’s a straight 50 years.”

31 MAY 1996 – BCDA Vice Chairman Mr. Rogelio Singson’s Response to Urbancorp Investment’s Mr. Leo Teehankee during the Second Pre-Qualification Conference for the Privatization of Club John Hay

Urbancorp Investment (Leo Teehankee) : “My question is if this escalation formula will operate from the 25th year on to the next five years which is the 30th year?”

BCDA (Rogelio Singson) : “No. The escalation happens every 6th year.”
Urbancorp Investment (Leo Teehankee) : “Yes, but it will carry over for the 50 years?”

BCDA (Rogelio Singson) : “That’s correct. For the full 50 years.”
Urbancorp Investment (Leo Teehankee) : “Will the committee consider applying this automatic ceiling to a 75-year period of (sic) just 50?”

BCDA (Rogelio Singson) : “No. We’re very specific about it. The lease period is over a 50-year period. And then all the improvements revert back to government… “

19 OCTOBER 1996 – ORIGINAL LEASE AGREEMENT (OLA)
• CJHDEVCO had the sole option to renew up to 50 years—without need of BCDA’s consent—extending it until 2046.
• The OLA did not provide for renegotiation of lease terms; it was a straightforward 50-year agreement from the outset.

2. BCDA Received and Fully Accepted Properties And Shares With A 50-Year Lease
14 JULY 2000 – MEMORANDUM OF AGREEMENT (2000 MOA)
• BCDA accepted rental payments in the form of 30 golf shares and 14 condotel units, valued at 75 million Pesos, all with 50-year leasehold rights valid until 2046.
• BCDA recognized that sales of 50-year leasehold rights to the public were necessary to fund Camp John Hay’s development.

3. BCDA Authorized the Sale of Properties with 50 Year Leases
18 JULY 2003 – MEMORANDUM OF AGREEMENT (2003 MOA)
• BCDA authorized CJHDEVCO to sell properties and golf shares, with 50 year leases, on its behalf and was granted observer status on the CJHDEVCO Board to monitor sales receipts.
• BCDA actively participated in multiple board meetings discussing the status of property sales.

2003-2010 - CJHDEVCO BOARD MEETINGS
• On 11 November 2003, BCDA Chairman Florencio Padernal attended the CJHDEVCO board meeting, where the Board approved sales of log homes with 50 year leases.
• BCDA representatives attended multiple meetings (2004-2010) where they reviewed and acknowledged ongoing sales of various properties under the 50-year lease period.
• BCDA was actively aware of property buyers and even promised to issue permits for the turnover of units at The Suites (now Forest Lodge).

1 JULY 2008 – FIRST RESTRUCTURING AGREEMENT
• Due to BCDA’s breach when Camp John Hay lost its Special Economic Zone status, BCDA agreed to restructure rental payments and take four seats in CJHDEVCO’s Board. This confirms that BCDA was not just an observer—it was a direct participant in all actions of CJHDEVCO.

4. BCDA Also Owns 50-Year Leased Units
• BCDA owns 16 Manor units and 10 Forest Lodge units, all with 50-year lease terms acknowledged in Limited Warranty Deeds (LWDs).
• BCDA accepted these properties with full knowledge that the leasehold rights extended until 2046.
• From 2009 to 2023, BCDA received their share of hotel revenues for their 50-year lease units in The Manor Hotel and The Forest Lodge Hotel.

5. The Facts Are Clear: BCDA Knew, Approved, and Benefited from the 50-Year Lease
• BCDA’s claim that it only recognized 25-year leases is false—it required a 50-year business plan, attended meetings approving 50-year lease sales, and accepted properties under the same 50-year lease terms.
• BCDA’s own documents prove it was a direct party to structuring and approving the 50-year lease model.
• For BCDA to now deny the rights of property owners, whom it encouraged to invest, is an act of betrayal.

Property owners at Camp John Hay must demand their rights be upheld. The 50-year leasehold rights were approved and endorsed by BCDA itself—they cannot simply erase their involvement. The government must honor its commitments and ensure that investors are protected, not deceived.
